Do you think animals of near-human intelligence (such as dolphins) should be treated like humans?

Should dolphins and other intelligent animals be treated the same as humans in the eyes of the law? Should they have rights because they are almost as smart as people?

This brings a larger question to mind, then is it ok to take the rights away from people that are seen less mentally capable, or in a lesser class.
Also Dolphins(and many others) require certain things in their environment that humans do, like social interaction and other things. To deny this to a human causes severe developmental issues, as well as it does in dolphins.
So I would vote yes, opposed to no in this, but my honest opinion is it really needs to be tailored to the situation based on the animals needs and requirements.
To assume that a situation is ok to animals and not to humans is very arrogant. For instance a dog should have toys, like a human child should also have toys because they mentally benefit from it (I am not saying give a dog a leapPad or anything).
It is abuse to not give your child toys and your child can be taken away from you for it, I think the same with dogs.
Until they can teach Obama to do this they are nothing but an animal
