    As long as there is a neutral municipal reason for the prohibition, it's enforced in a proportional fashion, and comports with basic First Amendment rights....

    Yes, but only if there are other places where people can sit down. Lots and lots of people have health conditions that require time to rest.

    The government shouldn't tell people who can and can't be on a sidewalk. This is ridiculous how much we need help from them.

    City's should be allowed to ban anything they like.. as long as that ban is not based on Race, Creed, Religion or Age. (and as per the addendums to the amendment to the constitution- Sexual Preference and Disability)

    If it is a high traffic throughfare on a daily basis, a qualtfied yes, there should be public setting available nearby.

    Of course not, a person should not be allowed to loiter for an extensive period of time but some people do become exhausted after shopping all day and they want to take a breather, and if there are not benches then the sidewalk is the only thing to sit down on then SIT DOWN. I am suprised by the people that wish to give this right away that we pay for with our taxes for fear of abuse from other folks. There is a difference between sitting on a sidewalk and loitering on a sidewalk.

    Yep - that will help keep the Occutards from disrupting commerce! It's a sidewalk, businesses rely on it for "foot-traffic"......foot-traffic equates to potential customers, customers buy goods and services, goods and services are taxed, taxes are collected to help fund the city banning the Occutard from disrupting the city's funding!

    Ugh, the "occutards" were in parks not sidewalks. Examine your answer carefully, you wish to take away the ability to grab a quick seat from those who do not loiter and may have had an exhaustive day of shopping along fifth avenue in new york from taking a breather because you foolishing want to get back at the occupy wallk street movement? I and countless others have spent exhaustive days walking and shopping along the high streets of my home in New York and in Paris, Rome and London and after a while have had to sit on the sidewalk!

    Your'e right, the Occutards camped in the park, but they also disrupted the business districts when they weren't peeing and defecating on each other. You realize that was the objective of Occupy, right? To disrupt businesses, making it more difficult for them to make money. Just ask Stephen Lerner, one of the organizers.

    And if you need to rest, which is understandable, the stores have places to sit inside, or find a bench, or a park, maybe a restaurant. Or if you're really tired from shopping all day, then maybe it's time to go home.....the point is that other people are walking on the sidewalk and they don't want to have to step over or around you.....that's why it's called a side-WALK!

    New York is already that way. If you are waiting in line for hrs at one of the tourist attractions you better have strong legs. Its become a miserable place to visit.

    I pay for that sidewalk with my taxes and I want to sit on it.
    Other people pay for that sidewalk with their taxes and they want to use the sidewalk too, possibly for walking or biking.
    All it takes is a simple "excuse me, sir, I am walking past you." "Oh, okay" type of exchange to solve this problem.
    People get so pissed that the government controls everything we do, and then they beg the government to do it because they can't even interact with each other.
