Camp Pendleton Marine Sgt. Gary Stein is facing a disciplinary hearing for engaging in online political activity. Stein, founder of a Facebook page called “Armed Forces Tea Party” already has been the subject of a preliminary hearing into his activities.In a release the Marines Corps said, after reviewing the findings of the preliminary inquiry, the commander decided to address the allegations through administrative action.

He can't be exempted from the UCMJ without making it meaningless to the rest of the military. America isn't quite as free when you put on a uniform as it is for civilians, but those are and always have been the rules.
He has the right to vote for whoever he wants, he can talk about politics in public when he's not in uniform, but he cannot be a political activist. If he uses his rank in posting online, it's the same as being in uniform because he's identifying himself with the military.
