Black descendants of slaves who were freed in 1863 by the Cherokee Nation now demand eligibility to tribal benefits: housing assistance, business loans, medical services, college scholarships and other benefits. The 1866 Treaty did not include citizenship to slave descendents, only those who shared common ancestry. The Interior Dept - who filed a counterclaim July 2nd siding with the descendants say they should have all rights of the native Cherokee Tribe. The same day, the descendants also filed their own claim that the Cherokee Nation violated the U.S. Constitution and should be reinstated into the tribal membership.
