Christians can be ordered to violate beliefs

A ruling from Judge Tim L. Garcia in the New Mexico Court of Appeals says states can require Christians to violate their faith in order to do business, affirming a penalty of nearly $7,000 for a photographer who refused to take pictures at a lesbian “commitment” ceremony in the state where same-sex “marriage” was illegal.


Judge’s Cynthia Fry and James Wechsler joined in the ruling by Garcia, which involved Elane Photography, whose owners, Elaine and Jonathan Huegeunin, are Christians and declined to do photography for lesbians Vanessa Willock and another woman.







The women complained under the state’s anti-discrimination requirements and a state commission, the New Mexico Human Rights Commission, imposed the penalty, which now has been affirmed by the appeals court judges. The judges explained in the 45-page ruling that the photography company is a “public accommodation” and those cannot discriminate under state law based on “sexual orientation.”


“The owners of Elane Photography must accept the reasonable regulations and restrictions imposed upon the conduct of their commercial enterprise despite their personal religious beliefs that may conflict with these governmental interests,” the judges wrote.


Officials with the Alliance Defense Fund, which has been representing Elane, said there would be an appeal.


“Americans in the marketplace should not be subjected to legal attacks for simply abiding by their beliefs,” said ADF Senior Counsel Jordan Lorence. “Should the government force a videographer who is an animal rights activist to create a video promoting hunting and taxidermy? Of course not, and neither should the government force this photographer to promote a message that violates her conscience. Because the Constitution prohibits the state from forcing unwilling artists to promote a message they disagree with, we will certainly appeal this decision to the New Mexico Supreme Court.”


It started in 2006 when Willock asked Elaine Huguenin to take pictures at her “commitment” ceremony. It was in 2009 when the ADF appealed a trial judge’s ruling in favor of the lesbians.


In reaching their decision the judges aligned photography with those that are “an essential service” under state law.


“Services, facilities and accommodations are available to the general public through a variety of resources. Elane Photography takes advantage of these available resources to market to the public at large and invite them to solicit services offered by its photography business,” the judges explained.


They cited the idea of a KKK rally asking an black photographer to supply his work, and the photographer refusing. Could then the KKK cite racial discrimination?


“The Ku Klux Klan is not a protected class,” opined the judges. “Sexual orientation, however, is protected.”


The judges continued, “The act of photographing a same-sex ceremony does not express any opinions regarding same-sex commitments, or disseminate a personal message about such ceremonies.”


They called the state requirement “a neutral regulation of commercial conduct” and said that it does not “infringe upon freedom of speech or compel unwanted expression.”


The judges wrote that the photography company’s claim of protection under the state constitution’s requirement that “no person shall ever be molested or denied any civil or political right or privilege on account of his religious opinion” was not applicable.


The judges suggested the interesting scenario of the photographer accepting the job, and vocally condemning the women while taking pictures.


“The owners are free to express their religious beliefs and tell Willock or anyone else what they think about same-sex relationships and same-sex ceremonies,” they said.


The district court decision had come from Alan M. Malott.


Malott’s ruling said the Christian owners were compelled to photograph the ceremony for Vanessa Willock and Misty Pascottini because of the state’s interest in preventing discrimination based on sexual orientation.


“Once one offers a service publicly, they must do so without impermissible exception,” the judge wrote. “Therefore, plaintiff could refuse to photograph animals or even small children, just as an architect could design only commercial buildings and not private residences. Neither animals, nor small children, nor private residences are protected classes,” he wrote.


When the district judge’s decision arrived, it seemed to substantiate the concerns of opponents of a federal “hate crimes” bill signed into law by President Obama during his first year in office that gives homosexuals special rights. Attorney General Eric Holder admitted in a congressional hearing that under the measure an attack on a homosexual would be dealt with differently than one on another citizen.


Benjamin Bull, chief counsel for the Alliance Defense Fund, noted at that time, “Homosexuals got exactly what they wanted. In the marketplace of ideas, one side has now been censored. This [situation] is exactly what homosexual activists have in mind.”


Interestingly, a subsequent poll revealed that almost half of Americans believe that Christians in the United States are being persecuted by homosexual “marriage” advocates who take legal action against them over their religious beliefs, and almost one in three Democrats believes such persecution is “necessary,” according to the alarming results of a new poll


The results are from a WND/WENZEL Poll conducted for WND by the public-opinion research and media consulting company Wenzel Strategies.


It found that 49.2 percent of all respondents consider the legal activism against Christians and their beliefs regarding homosexuality to be “persecution.”


The question was, “There is a trend developing in which gay activists are filing lawsuits against people who refuse to do business with them on moral/religious grounds – such as when a New Mexico photographer was sued by a lesbian couple for refusing to photograph their wedding. Knowing this, which of the following statements most closely represents what you think about this?”


More than two of three Republicans called it “persecution of Christians,” along with 45 percent of independents. Even 33.1 percent of Democrats had he same answer.

    I have my "King James Version" of the story book right here before me. Should I toss it away as having been declared "null and void" by
    a later edition? Seems that if "God" wrote these words or instructed
    they be written, then only "he" could revise them. Did "he" spin down
    here again and leave us some scrolls or tablets? Who is in charge of
    "revising" these "words of God"? Popes? Evangelical preachers? Maybe television preachers like Joel Osteen or Jimmy Swaggart? When will they next publish a revision, which could clear up these
    confusions about daughters, slaves, gardeners, dresses, and shellfish?
    Barnes & Nobel or Amazon would surely like to have some new versions to sell. Or, are you the one to "revise" these "eternal words"?
    Ah ha, you are the source of the new "revisions".

    I gave you the quote in the King James Version - believe it or not - the choice is yours.

    The requirements of the law have been fulfilled. Why are you trying to change it? For what purpose? You aren't even an Ancient Hebrew - do you even understand the purpose of the law? or why it was enacted in the first place? What does it represent? Who enacted it and why? When was it enacted and why? For how long?

    I know the "Old Testament" is part of this book in my hands and is widely taught to children and others as being part of "the word of God" that is "eternal and unchanging". Have you ever heard those claims made for the book? If the "old part" is worthless and outdated, then get rid of it and end the confusion of who can "revise" the "word of God". You obviously can. Others can too. The "word" has been revised and rewritten numerous times to suit the needs of the Catholic Church, then the Protestant Church, and who knows how many more times. There are dozens of other "books" claimed to be part of the "word" that have been discounted by some, revered by others, all part of the silly mess that is this compilation of fairy tales and conflicting stories from the ages past. Alice in Wonderland makes a lot more sense than these silly stories.

    Cut through all this BS, please. Just tell me if I can sell my daughter, own some slaves, kill my neighbors, or not. If NOT, then why not?

    They think Christians are subject to Judaic laws. Not understanding the difference in covenants seems to confuse them, and not understanding that CONTEXT and AUDIENCE being addressed in the Bible makes a HUGE difference as to everything.

    No Christian is under this law nor have they ever been - why are you so interested in their covenant? Most of it has to do with the now non existent temple. Are you interested in bringing back the temple and re establishing these laws - and for what?

    That's what I thought from the beginning. Thank you. Now, I can thow this useless story book away and get on with doing what seemed right from the beginning, just sending the daughter off to college and getting the ladies a green card, and making peace with my neighbor.     I've heard that too. In fact, a friend who claims to be an authority on such matters, says that there is room in "Heaven" for only something like 14,400 "souls", and the numbers are already filled with a waiting list miles long. Whadda think? Are the party invitation all mailed already?

    My friend is an expert in such things, having spent years studying the teachings of the Dallas Theological Seminary to an extent beyond their Doctoral program. He reads the various "bibles" in their original languages, and has copies of all of them and the various "books", schrolls, tablets, and writing that have been hidden from the "believers" by those who "edited" the several versions of the story books. I have to take his word for the numbers as I think it is all a foolish hoax and couldn't care less who is among the "numbered" whether large or small. That's the trouble with such things, there are a thousand differing ideas and versions of these stories from ages when superstitions were passed along by
    word of mouth and written by the few who were literate in various languages. Like the party game of whispering a "clue" around the table, what the final version becomes is hardly recognizable by the one who commenced the story.

    He reads all of the "bibles", the dozens of them that have been used over the years and around the world, all claiming to be "the one" that contains the "words of God".
    Then, there are hundreds of translations of letters, texts from ancient "Christians" and "scholars", etc., etc.,... thousands of such things. I can imagine the libraries of the Vatican are filled with such stuff. Recently I read that the Vatican libraries contained miles of shelved "documents" defining the origins of Christianity. Of course, they make public only those that fit their purposes, as would any such secret society.

    You have a quite limited vision of the small world of "the Bible" and the interpretations of it you are directed to follow. It is a book assembled by persons for a purpose,
    which is to control your mind and lead you to believe what they would have you believe, which suits their purposes.
    There are dozens of "Bibles" out there, hundreds of stories edited, included, and tossed aside, all with a purpose of making "religions" work for particular purposes.

    As Jefferson said, it is the most dangerous of the concoctions of mankind, causing more grief and
    confusion than it could ever misplace. Take the
    good and positive parts to heart and leave the rest
    to the wranglings of "theologians" and fools.

    At this very moment, I'm sitting here watching my neighbor working on his John Deere tractor, getting ready for his Sunday morning mowing. I'm debating whether to tell him I can now shoot him and defend myself with the "unchangeable word of God". If his wife comes out in her cotton-polyester robe I can do her in too, with the same excuse. I've already asked the neighbors to join me to rid ourselves of the fellow who grows a variety of vegetables in the same garden plot, but so far none have agreed to help me. Somehow I think my defense could be linked to the "Stand your ground" laws that these wingnuts also value. I will just "stand my ground" when they invade my space with their violations of "God's word".

    At another page here on SH one of the "Christian" scholars has advised me that all the tribes and races of the earth appeared like magic just 14,000 years ago, when "God" and the angels came down in spaceships to the earth and vacationed here for a week, leaving all the millions of species and plants. Another old fellow, walking around in gold robes and waving a pot of burning incense while chanting silly accola...

Should I try to intervene, of just let them pollute the air with that awful smell of burning human flesh that so "glorifies God" by killing witches?

    Uh, are you aware that Christianity is based on the NEW Testament and the rules you are sighting are for Jews, not gentiles and Christians???????

    New Covenant versus Old. Christians practice the new covenant, and not Jewish law.

    Then, why do the "new ones" print tens of millions of copies of the "old ones" and distribute them around the world, calling for all the mindless readers to "follow the
    word of God"? Why not come out and clearly say what you claim - "God's instructions
    of an earlier time were wrong, he didn't mean all those things, so forget them and just
    read the first half of this book". When will the next revised issue be published? Maybe
    all the conflicts of today will be cleared up in the new versions?

    So, God told Jews one thing and told gentiles something else? That could explain why there is such conflict in the world and Jews are so constantly isolated and feel threatened by almost everyone else in the world? God caused the turmoil intentionally by making two differing sets of rules? If I were a Jew, could I bring my two pretty "slaves" across the border, and sell my mouthy daughter to the highest bidder? Help, I'm becoming more and more confused with this book that seems to be two conflicting stories bound into the same volume.

    And, child, you did not read my opening comment where I citied each of the "permissions", actually orders, to do all of those things, in the name of the "eternal and unchanging word of God".... and, if you wear cotton/polyester clothes, jean, you are on the list for justified annihilation also. Better wear your sweater wrong-side-out to show the "100% Wool" label.
