Would an undocumented person, if arrested – for being in the United States illegally or for the commission of any other crime – have the right to act as his own attorney, in his own defense?
If we answer 'yes', and we must (the 14th Amendment's Equal Protection Clause extends to all persons, not just citizens), then we must admit his right to act as an attorney does not derive from his citizenship.
If one's right to act as an attorney does not derive from one's citizenship, then where is the barrier, or by what prerogative would any other person, judge or government official deny said person?
Accordingly, an illegal alien is NOT constitutionally entitled to Due Process or any other constitutional right, only to SUMMARY JUDGMENT, same as a military tribunal would dispense.
