Calif Teen Sentenced for Killing Gay Student

A Southern California teenager was sentenced on Monday to 21 years in state prison for shooting a gay student in the back of the head during a computer lab class three years ago.

Brandon McInerney, 17, didn't speak at the hearing but his lawyer Scott Wippert said his client was sorry for killing 15-year-old Larry King.

"He feels deeply remorseful and stated repeatedly if he could go back and take back what he did he would do it in a heartbeat, Wippert said.

King's family said they couldn't forgive their son's killer.

"You took upon yourself to be a bully and to hate a smaller kid, wanting to be the big man on campus,'" King's father, Greg King, said on behalf of his wife. "'You have left a big hole in my heart where Larry was and it can never be filled.'"

In a deal reached with Ventura County prosecutors last month, McInerney agreed to avoid a retrial and to plead guilty to second-degree murder, as well as one count each of voluntary manslaughter and use of a firearm.

A mistrial was declared in September when jurors couldn't reach a unanimous decision on the degree of guilt. Several jurors said after McInerney's trial that he shouldn't have been tried as an adult.

Leading up to the February 2008 killing, teachers and students saw a dispute growing between King and McInerney, who shot King twice in the head in a computer lab at E.O Green Junior High School.

McInerney, then 14, had reached an emotional breaking point after King made repeated, unwanted sexual advances toward him and other boys, defense lawyers said. In the weeks leading up to the shooting, school administrators allowed King to wear heels and makeup because federal law provides the right of students to express their sexual orientation.

The case drew widespread attention because of its shocking premise and raised questions about how schools should deal with students and sexual identity issues. Comic Ellen DeGeneres, a lesbian, weighed in on her talk show shortly after the shooting and said gays shouldn't be treated as second-class citizens.

Because of pretrial publicity, the trial was moved from Ventura County to Los Angeles.

Prosecutors said the shooting in front of stunned classmates was first-degree murder and that McInerney should be punished as an adult. They argued the shooting was a hate crime, an aspect jurors rejected, after authorities found white supremacist materials in his home.

Defense attorneys, who unsuccessfully argued to keep the case in juvenile court, said it was voluntary manslaughter because McInerney lost control of his emotions. They said the teen was beaten by his father and was described as a bright student who lost his motivation.

King's father also blamed the school district for not doing more to address the brewing feud between the two teens and their son's flamboyant behavior.

"Instead of protecting him from himself and his poor impulse control, they enabled and encouraged him to become more and more provocative," Greg King said.

King's family and Deputy District Attorney Maeve Fox wore buttons with the teen's face on it, while some of McInerney's supporters wore powder blue wristbands that read "Save Brandon."

After serving nearly four years since King's slaying, with the additional 21 years McInerney will be released just before his 39th birthday.

His murder conviction will be stayed, and the plea deal calls for McInerney to be given the harshest sentence under California law for voluntary manslaughter — 11 years — and use of a firearm — 10 years, prosecutors said. McInerney is ineligible for time served or good behavior because he pleaded guilty to murder.

    If King's repeated sexual advances bothered him, he'll be in for a lot of hard times (no pun intended) in prison. That's better than the death penalty because every time another prisoner mounts him he'll be reminded of his crime!

    Brandon McInerney shouldn't have been tried as an adult. Prosecutors were playing politics and using conviction to obtain votes. The school totally failed to live up their duties and defuse this situation. Mclnerney's parent should have removed him from the school until this problem between the boys was resolved.

    No they can't in 2005 Roper v. Simmons. This ruling overturned a 1989 Supreme Court decision in Stanford v. Kentucky, which allowed the execution of persons who were age 16 or 17 at the time they committed their crimes. In Roper, the Court held that the execution of a person under the age of 18 is disproportionate punishment under the Eighth Amendment and, therefore, is cruel and unusual punishment."

    i say it is correct the sentence because god, no one notices how many homosexuals are getting killed by the weeks and months some even by days were i live gays and homo's get killed alot if you count half of the people that die here are homo so yeah

    That just isn't right. I kinda think he deserves to live with knowing what he did, but then again i kinda wish he'd get the death sentence.

    Oh god. I'm actually glad he didn't get the death penalty--he should have to live with this for the rest of his life.

    Why did it take 3 years to convict, or get a guilty plea, on someone who shot his victim execution style in the back of the head with a classroom full of witnesses?

    Just like with other crimes ,when they want to trie a teen as an adult they hold them in jail & wait till they are almost an adult to trie them because for over 20 years now thats what has been done they refuse to hold the trial of a 10, 11,12,13, 14 or 15 year old because they would have to trie them as kids they want to trie them as adults.

    I just got done reading all of the responses here and I am frankly appalled at some of the answer that were given.

    If ever there were a case for a defense based upon child abuse from a parent this is one of those cases. At the same time I can see and understand the position of this child and his repsonse to his victim's alleged sexual advances.

    Please do not misunderstand my statements, Violence solves nothing. Frankly if I were to place blame here it would be on all three of the authority figures in this case. The victims parents, the murderer's parents especially the father, and the school district and the teachers involved with both students. The highest level of responsiblity lays with the school since they were charged with the care of BOTH students.

    The 21 years fits the crime under the SCOTUS ruling considering the age of the child-murderer. The death penalty was off the table before the trial even started.

    Completely agree.
    He didn't accidentally bring a gun to class. He didn't accidentally fire it TWICE. This was very premeditated. The Gay aspect of the situation is almost incidental.
    This was a public execution style murder.

    Although I am not an advocate of homosexual activities or lifestyle, I like to thnk that lil'
    Brandon is about to discover a lot about the "gay" lifestyle in prison. Six months from now he will probably be much more aware of what "gays" do when the lights are turned out.

    There should be no "hate crime" law.
    He should have gotten a MUCH LONGER sentence. (I would have preferred him being executed for the murder.)

    He should have been sentenced to life without the possibility of parole or sentenced to death. I would not want to see an animal like that out in society again after a short 21 years or early parole.

    This is a very worrying thing, because I have multiple friends who are gay and I believe I may be gay myself, though I haven't "come out" yet to anyone I know.
