Arkansas Anti-Nudism Law: Sensible or Silly?

Nudism is accepted or at least tolerated everywhere across North America. Everywhere, that is, except the state of Arkansas. Arkansas has a law the strictly prohibits the practice of going socially nude in mixed settings, or even advocating the practice. Here is what the law says:

S 5-68-204 - Nudism.

(a) As used in this section, "nudism" means the act or acts of a person or persons congregating or gathering with his, her, or their private parts exposed in the presence of one (1) or more persons of the opposite sex as a form of social practice.

(b) The provisions of this section do not apply to the enumerated acts if:

(1) The purpose of the person committing the act or acts is to render medical or surgical treatment or to determine the need for medical or surgical treatment or to cleanse such sexual part, and the person committing the act:

(A) Is a licensed physician, as defined by § 17-80-101, or any such physician of a sister state making a professional call into Arkansas;

(B) Committed the act under the professional direction of any physician described in subdivision (b)(1)(A) of this section; or

(C) Is a nurse duly registered or licensed by the Arkansas State Board of Nursing; or

(2) The persons are married legally one to another.

(c) It is unlawful for any:

(1) Person, club, camp, corporation, partnership, association, or organization to advocate, demonstrate, or promote nudism; or

(2) Person to rent, lease, or otherwise permit his or her land, premises, or buildings to be used for the purpose of advocating, demonstrating, or promoting nudism.

(d) Any person, club, camp, corporation, partnership, association, or organization violating any provision of this section is guilty of a Class A misdemeanor for each offense.

(e) This section does not repeal any existing laws of the State of Arkansas except those in direct conflict with this section but this section is cumulative to the existing laws of the State of Arkansas.

    We are a family of nudist and don't believe people should be forced by law to wear clothes if they choose not to. We live out in the country and go naked indoors and out.

    It's already illegal to expose yourself in public, etc. If people want to get together in nudist colonies or nudist resorts, they should be able to. As long as they're not doing it in front of me, I'm not fussed.

    This law doesn't just make it illegal to be nude on a public street, (which is illegal in most places anyway). It makes private nudist clubs, resorts, beaches etc illegal altogether.

    I don't see how it hasn't been declared unconstitutional unless it isn't really enforced. I know you can go to some of the hot springs and be ok, at least that used to be true.

    The law was passed quite recently; in 1994. Were those naked hot springs from before 1994?

    No, it was illegal, but it wasn't really enforced, at leas to the best of my recollection. This was late '90s when I was down in Springfield, MO and went to take a dip in the hot springs one weekend. Maybe they've cracked down since then, but I don't know.

    I suppose, next, Arkansas will pass a law making it illegal to leave Arkansas for the purpose of practicing nudism somewhere it's legal.

    That would be unconstitutional. The way the culture is going (and global warming) I see in 10 years public nudity becoming more mainstream.

    That may be unconstitutional, but the law Arkansas already has on the books banning nudism is unconstitutional. Who's to stop Arkansas lawmakers from taking one more unconstitutional step further?

    We should have a Nude Scouts of America powwow in Arkansas!

    Then when it is BUSTED, use that court case to take it (eventually) to the Supreme Court of the USA.

    That'll Show 'Em (In more ways than ONE).

    Many consider Nudism, self expression, even a religion. Is this Arkansas anti-Nudism law, therefore, a First Amendment violation?

    I think it is. I don't understand how it ever came into force. It's not even an old law. It was passed in 1994.

    I have had very nearly religious experiences while in the nude, but I would not call nudism a religion.

    No court would declare "nudism" to be a religion >.> It doesn't meet the criteria. Therefore, the first amendment has nothing to do with this.

    But the part of the law saying it's illegal to advocate nudism would violate freedom of speech, and the anti-nudism law itself is a violation of freedom of peaceful assembly.

    Back to the issue of nudism.
    People are going to be people and do what they want as far as nudism goes, no harm done, let them be themselves!

    That painting means more to me than most know. It's the image i saw for 6 days every mourning as my girlfriend washed herself in the mourning surf.
    I rented an island in the cayman islands years ago, as there are hundreds of small islands the size of a football field for rent for around $800 a week. There is a small hut built on the islands, with facilities to barbecue and cook meals for a week long. The temp is a constant 69 to 79 and you are the only ones on the island, so naturally we did not wear any clothes, Ha!
    I never forgot waking up each mourning and seeing her in the morning surf washing herself.............. just like the painting! (and she looked just like the woman in the painting, a red haired diva, Lol).

    I guess the Law makers in Arkansas missed the class on why Probation didn’t work?
    May I humbly suggest that they read the following?

    Amendment 18 - Liquor Abolished. Ratified 1/16/1919. Repealed by Amendment 21, 12/5/1933

    Would communal showers for sports teams be allowed?...Why did this law need to be put into place? So people could be entertained by finding loopholes?

    This law seems to have closed pretty much every loophole. It's effectively even illegal to lobby to overturn the law, because that could be considered "advocating nudism." Perhaps a more effective strategy would be to lobby to repeal the part of this law making it illegal to advocate nudism. Then, after that's repealed, lobby to overturn the anti-nudism law itself.

    And unconstitutional against freedom of speech. Definitely not a law that belongs on the books of "The Land of the Free." If this law were applied strictly, I guess it would be illegal for a father to bathe his young daughter, or for a mother to bathe her young son, or even for siblings of opposite sex to bathe together. Can't see what good a law like this does.
