Arizona case: what should Arizona do about it?

The Arizona opinion found three parts of SB 1070 invalid:


  1. Making failure to carry a green card a State crime, and prosecuting that in State courts.
  2. Criminal penalties for hiring any person found unlawfully present in the United States.
  3. Allowing Arizona police to arrest someone upon “probable cause” to suspect that he is in the country illegally, but without a specific warrant.

The Court held that only the federal government, as a “single
sovereign,” has the power to regulate immigration. Arizona was trying to
take a federal matter into its own hands. This follows from Article I,
Section 8, Clause 4 of the Constitution.
Under that clause, the Congress sets “a uniform rule of
naturalization.” In addition, arresting someone on suspicion of being in
the country illegally, without a warrant, might break the Fourth
Amendment. It would be an “unreasonable seizure.”


But the Court sent back to the Ninth Circuit Court of Appeals the one
part of SB 1070 that Arizona Governor Jan Brewer most wanted to stand.
That part says that the police may check the immigration status of any
person whom they stop or arrest for any other reason, if they have reasonable suspicion that the person they stopped or arrested is an illegal alien. On that ground, Governor Brewer claimed “victory for the rule of law.”


The Obama administration reacted swiftly and shockingly. It suspended
all cooperation between the Immigration and Customs Enforcement service
and State and local police forces in Arizona. So now, local police may
check immigration status on anyone they stop or arrest, but the federal government won’t act on this information. In fact, they won’t even talk to local police when they call.

That made Justice Antonin Scalia terrifically angry.

He said flatly that the federal government doesn’t want to enforce
any laws against illegal immigration. Worse yet, the federals want to
“leave the States unprotected.” Scalia cited the recent Executive Order
that federal authorities would no longer deport most illegal aliens who
came to the United States as minors.

Are the sovereign States at the mercy of the Federal Executive’s refusal to enforce the Nation’s immigration laws?


Scalia went further: he suggested that no State would have ratified
the Constitution if the Constitution put that attitude in writing.


Imagine a provision—perhaps inserted right after Art. I, §8, cl. 4, the Naturalization Clause—which included among the enumerated powers of Congress “To establish Limitations upon Immigration that will be exclusive and that will be enforced only to the extent the President deems appropriate.” The delegates to the Grand Convention would have rushed to the exits.

Channel, has picked up on this yet. A Justice of the Supreme Court just
told the world that the States ought to consider seceding from the
Union, and no one could blame them. As Paul of Tarsus might have said
(Galatians 1:6): wow. Just—wow. But: can anyone blame him for saying so?

    No matter what the Obama Administration decides they're NOT going to do, it doesn't change the fact that we Arizonans are tired of illegal immigrants running RAMPANT across our State, and we now have the LEGAL authority to take steps to ensure our safety. If that requires our law enforcement professionals asking for proof of citizenship, so be it. I can live with that.
    Now that Obama, Holder, and Napolitano have decided to IGNORE the law, by DELIBERATE inaction, maybe its time to start impeachment proceedings? The President SWORE AN OATH to uphold the Constitution, and the LAW. If he is now unwilling to do that, then he no longer deserves to be President of the United States of America!

    What I find amazing about this whole spectacle, is the fact that SB 1070 mirrors the Federal immigration law.

    What was the problem?!?

    I can tell you what the problem was, and IS... Obama cares more for his special interest groups, than he does for the safety of the country.
    And THAT makes for a sad state of affairs for EVERYONE!

Take any person that you can determine that is an illegal to the border of AZ and invite them to leave the state, to the south. Execute SB1070 in spite of the feds, since everything in SB1070 is exactly the same as federal immigration law.

    I wouldn't like to see an armed conflict because you are going to get innocent combatants killed or injured.

    I think a standoff would be good. If Texas would support Arizona, it would be all over for Obama. Texas is the only state that can legally succeed from the union.

    Now, would be the time to do it with Obama up for reelection. Liberals would hate it. It would make a fool out of Obama.

    I think if a Karl Rove would organize it, challenging the Obama government would be devastating to Obama.

    However, I am talking about legally with a minimum of actual force. It is possible for a local law official to throw a Federal agent out.

    It is one of the reasons Holder doesn't send his goon to Sheriff Joe. Granted the Federal government could use force but that would be stupid.

    I think AZ my state should ignore it just like the Obama administration does. AZ has laws on the books and they should be followed Who cares what the federal gov't does! Arrest them if they interfere!

    what should the state do ? They should join with other states in armed opposition to a federal government that has broken its own laws and must by destroyed at all cost , America is dead anyone standing in the way is a part of the problem not a part of the solution !
    By ignoring the constitution and using their own personal bias the supreme court has set in motion a revolution that must come ….I usually avoid calling for an armed overthrow of the government by FORCE and at ALL COST ...but then again I have never before been face to face with a government that in no way follows the laws …....America is dead people ! When the Federal government starts selectively picking on and attacking ONE state....it should be regarded as an attack on EVERY state. ALL states must band together and REPUDIATE and BOYCOTT and withdraw COOPERATION with an EXTREME, out of control administration. If Obama wants a fight, he should GET one!! He's way overdue for impeachment and now way over half the population realizes it. Stand up and be counted. Express your self to everyone who will or will not listen.

    The #ucking IRS knows EXACTLY where a hell of a vast majority of the illegals are (seeing as these invaders are allowed to xxx-xx-xxxx to get a $hitload of money off of our dole through them, claiming any amount of kids as dependents even if they aren't their own to get THOUSANDS off of each one)... they should be the ones reporting them, and letting I.C.E round up, detain, seize the assets and funds of, and deport the SOB's!!! Failing that, let the States handle it themselves - seems our federal government has gone entirely rogue and IS NOT what it is supposed to be, Constitutionally speaking.

    That's how I would handle it if I had the power in any capacity to do so. Force the IRS to report them, force I.C.E. and every other federal agency to DO ITS JOB!

    Notify ICE, take the illegals into custody, and HOLD THEM until they are retrieved by ICE. Build "Gitmo of the Desert" if necessary.

    Another alternative would be to hand out free bus tickets to California, where a helpful Arizona state employee would ride the bus and help the passengers fill out applications for welfare, medicaid, and food stamps. When Arizona cops catch an illegal, they can offer a choice: jail or bus. In honor of our illustrious President, I would put a huge mural of Obama on the side of each bus.

    Unlike Arizona and Texas, Obama actually cares about California. As soon as the first few buses showed up in LA or SF, he would rethink this position -- probably to the benefit of all the border states.

    I wouldn't be too sure of that. We already have the highest Illegal count (in just those that we know of anyway) of the entire Nation, and two $hits have NOT been given for it yet. I doubt busing a few million more in would make any difference. He wants them as his voter base (because even Legal Liberals are turning on him) and not to put too fine of a point on it, he hates "whitey" too - just as much as they do... the hypocrite.

    I'd be there in a heartbeat if I could. Point of fact, I'd be a fool to take a bus over and have no place to live (and no family out there) or a guarantee of a job to pay rent or whatever, otherwise you can bet your bottom dollar I'd be getting out now. Anywhere else would be better than here at this point. This State is just VILE now.

    And honestly, these idiots (including the bleeding hearts) have obviously overlooked the fact that 'hispanics' came here from SPAIN, it was THEM who slaughtered the Aztecs (not that the Aztecs weren't already slaughtering each other but that is besides the point) in the Spanish Conquest of the Aztecs (1519 to 1521)! But oh no, they won't teach that in the libtard schools! Nor the fact that the 'native american' Indians (which I share a little blood with, roughly 3%) came here from Siberia (DNA studies prove this) through the Bering Straight. Therefore, these Spaniard bastard Mexicans have NO claim to this land anyway - even before the fact that we BOUGHT CA, NV, UT, AZ, NM, TX, WY, CO, OK and KS from them, no theft involved whatsoever unlike their total theft of Mexico!     That's just it. He thinks it's his job to let 'em in, so that they can call a plebiscite and retro-cede Arizona, New Mexico, and Texas back to Mexico, so that he doesn't need so many electoral votes anymore. (He'd like to keep California. Tell you what: I'd just as soon give up California.)

    What we have here is a Constitutional crisis. Constitutionally, it is the job of the Executive Branch of the Federal Government to enforce the laws and uphold the Constitution. And rightly so, that has been upheld by the Supreme Court, denying Arizona the right to enforce immigration laws and protect the border. The problem is, the Executive Branch has openly refused to uphold it's Constitutional obligations. So if the state can't, and the government won't, what is a state like Arizona to do?
