Alleged Colorado Shooter Is Charged With 24 Counts of First-Degree Murder: Should He Get the Death Penalty?

James Holmes, the alleged Colorado gunman who killed 12 people and injured nearly 60 others, has formally been charged in court. The 24-year-old former post-doctorate student was charged with 142 offenses, including 24 counts of first-degree murder and 116 counts of attempted murder.

If convicted, Holmes could spend the rest of his life in jail -- or even get the death penalty, though prosecutor haven't yet revealed if they'll be seeking capital punishment on this case. Do you think the death penalty is appropriate for the alleged shooter?

    Hanging would be nice, too. I don't think that Colorado does that anymore, though. Unfortunately, their only allowed means of death is lethal injection. So sad.

    Yep, change the law for sure and lets start fighting back against these stupid lobbys anyway......most are for no good for the average person. We need to stand up to these powerful corporations (who are NOT people, haha) and the NRA is another big one. My suggestion to that is the people in the nra who do not believe we should have assault weapong should just get out of their membership............the people can do a lot if we all stick together. GO OBAMA 2012

    I am convinced we need to do it like China does. Firing squad, and the family foots the bill for the ammunition used for failing at their job as parents.

    I'm not opposed to that! Though I always found firing squad to be too good for some people, personally. Probably because I associate it with soldiers' executions from way back.

    I am by far NOT a vicious person but when I see or hear that a person could do what he did to innocent victims, I could probably watch them all shoot him. Why should WE pay for him to live and our tax dollars pay for all he needs? NO WAY..........and he knew exactly what he was doing too!!!

    Oh I have a feeling maybe at that time he didn't care but now he might feel different. George Zimmerman was cocky at the time but when he got to court, you could see how scared he was but being I had lived in Florida with the Casey Anthony trial, he will probably get off too and he sure should NOT!!

    I'm saying that the intent to commit murder was completely indiscriminate, and so each potential victim should be counted as an individual.

    1. 12 counts first degree capital murder; 2. 12 counts of felony murder; the murders occurred in the commission of one or more felonies.

    thanks I was wondering why Colorado does things that way but did not take the time to look it up (way to much international news yesterday) ....I got a BLOCK ban by the "legion of ultra racists" * (its an offshoot of the Sock-puppets) this week ...people I have never talked to blocked me and then went on to brag in posts about having done so ....some people are very shallow and ignorant LOL

    * they will not be around long as they only want to talk to each other and will block anyone who does not support their pre-set Ideas about what is or is not Racist ....they will go away after November as such groups always do LOL

    we did talk facts a lot more before the 08 election and we can hope to do so again someday but only if we get the race thing off the table ...its a distraction and just gets in the way of any real conversation .

    Exactly! Black or white (or both) meant nothing to those on the right in that election. Only the left. They got obama in just so they could claim the accolade and awards for diversity.

    I didn't have turd one to give caring whether he was black, white, orange or whatever. It was his POLIITCS that scared me. I'd have loved to have had someone like Herman Cain or Condoleeza Rice. And not because they're black, but because I side with their political opinions.I don't side with all of them but their mind set is closer to mine than is the mindset of the liberal left.

    I know what you mean but technically under the criminal law, "conspiracy" charges requires at least two people be involved in the plan and move forth with the plan, not just a plan by one person. The definition of "conspiracy" in penal law requires two or more people.

    Evidence of pre-planning IS VERY GOOD evidence of intentional murder ...not necessary to conviction though. Intent can arise in a split second...its the jury that decides if its intentional or reckless.

    ATTEMPTED Murder would be the charge for an individual, acting alone, who intended to kill everyone in the theater but didn't. .
