School Teacher Marie Jarry Sues School After They Fire Her For Being On The Howard Stern Show: Is her anger justified?
In May, Marie Jarry took a day of sick leave to go to the Howard Stern show to compete in his "Hottest wife, Ugliest husband" contest (she works as a school teacher). As part of the contest, her photos were taken in a bikini. Needless to say, she won the contest and the $5000 prize that went along with it. Unfortunately for Jarry, however, these photos would soon be passed around the school where she worked.Upon hearing of the circulation of these photos, school officials at the Thalberg School fired Marie. Jarry subsequently sued the school alleging that school officials denied her due process and practiced sexual discrimination on her. Jarry wants monetary damages, back pay, reinstatement and attorney fees.
Does Marie Jarry have a right to sue the school?

I would say the she does not have the grounds for a law suit if she was fired for the right reason. It she had taken vacation then she should not have been fired. If however she was fired for abuse of sick leave then she deserves the punishement for breaking the rules. So I say she has no right to sue but this changes if she was in fact fired for the bikini photos then she should have legal grounds but abusing sick leave is a viable reason for termination of employement. -

People sue too much in this country.
She did something stupid and she got fired for it. Bottom line.
These people are the ones that teach and guide our children. They should be good role models. In my mind, what she did was not the act of a good role model. -

Since this is the United States, sure she has a right to sue. As a teacher, she should have been smart enough to know that there would be repercussions from going on the Howard Stern show and posing in a bikini. It's called common sense. I think that there would be any other numerous employers who would frown on their employee posing for shots such as these and in this context.
Now, if she had been on the beach and there was a shot that was taken of her that was circulating around school, that would be another matter entirely because she didn't purposely place herself in the position where the students could easily access that photograph. It's innocent. If, however, she was on the beach in a bikini, a "Girls Gone Wild" photographer came by and she flashed herself in front of the world ... it would change matters yet again.
As a school teacher myself, I am very well aware that I am, whether I like it or not, a role model to my students. Yes, a teacher may feel that 'my life is my life', but then again there are 150 children who are looking at your life and trying to find any excuse to not pay attention to any word that you are saying. It's hard enough to teach the students all they need in the time allotted, why would you want to place the image of a bikini-clad teacher in the way of that education? -

I would say she does because basically they are saying she isnt allowed to enter a contest and she did that on her own time its not like she was with a student or at the school doing so they did not have the right to fire her! -

Answered Eh, she shouldn't have been on the show, but at the same time she probably shouldn't have been fired for it either.
It seems the reason she was fired was due to the nature of the Howard Stern show, some of the things she on the show and the posting of the pictures on his website. Parents of some of the students had complained about her. It was poor judgement on her part for being on the show but apparently some of the parents watch the Howard Stern show. However, the school said that she violated a school "morality clause" and took a bogus sick day. Either way she really shouldn't loose her job if Conn is a right to work (right to fire) state there isn't much she can do about it. -

What could she be thinking? Howard Stern is just plain trashy, and everyone knows that. If she'd just entered a swimsuit contest, that would be something different, but she chose to appear on the Howard Stern Show, a show associated with very amoral people. She should have been fired, and she should get another job, (maybe something on the streets) if that's the kind of life she wants to live. A loose lifestyle is not conducive to being a school teacher -- someone who should be an example of wisdom and integrity. -

Not every job has 'personal days'. She was fired because of the pictures, not from using a sick day. Every news article I have read about this clearly states she was fired because of the photographs, and *nothing" about her using one of her paid sick days. And if you think that i adequate reason, I am fairly certain at least half of the US working force should be fired for same thing. -

The slow heads at the school admin probably didn't know anything until the pics poped up. Granted they could've disciplined her in another way but then you have to think of the pics and where they origenated from. Stern is not exactly known for modest shots.

If I were a judge I would throw this out of court the min I was asked to, a teachers contract has a clause in it about moral terpitude and this is a violation of the contract. How can this person be a public servant that is to be held in high estem and an example for children. Just another example of moral decline in the society. -

The teacher allegedly got fired because there are pictures of her in a bikini being circulated. If she was at the beach in a bikini, and some kid took a picture and started circulating it, would she have suffered the same action? -

If you fire someone because they aren't doing their duty, but you also tell them you are firing them because you don't like their blond hair, you're screwed.
