A 56-year-old Milwaukee man is accused of shooting his lawn mower because it wouldn't start.Keith Malinowski's has been charged with felony possession of a short-barreled shotgun or rifle and misdemeanor disorderly conduct while armed. According to the criminal complaint, Walendowski says he was angry because his Lawn Boy wouldn't start Wednesday morning. He told police: "I can do that, it's my lawn mower and my yard so I can shoot it if I want."

A woman who lives at Walendowski's house reported the incident. She says he was intoxicated.
Walendowski could face up to an $11,000 fine and six years and three months in prison if convicted.
A call to Walendowski's home went unanswered Friday.

Yes. He has the right to buy stuff and shoot it.

The problems come from having the "short barreled shotgun" and the "misdemeanor disorderly conduct" stuff. Which the lessor will probably be thrown out in favor of the weapon charge. And I'll bet the woman living at the residence also gets thrown out unless it's a relative or wife......

But like all legal stuff, you always get told the worst you can get. Court time comes around and I'll bet he gets a lot less.

When I pulled a gun on 3 cops, they told me I could get 21 years (7 for each cop) but I only got probation....

(and I heard through the grapevine that the mower shot at him first....lol)

You should be able to destroy your own stuff if you want to, but you should not touch a weapon if you ar intoxicated unless you are in iminent danger. He can put his neighbor's at risk if he can't aim under the influence. Charge him with discharging a firearm in a residential area and throw in something about the intoxication.

If I read the article right he didn't get busted for shooting his lawnmower, he got busted for having a sawed off shotgun. He probably would have gotten a fine for discharging a weapon within the city limits but sawed off guns are illegal everywhere.

I'm pretty sure you can't shoot anything in a residential area, at least not here. I doubt he'll get jail time though, probably a meager fine and, if he was intoxicated, orders to go to AA or something.

um....yes, if he's sober and it's not a sawed off or short-barreled shotgun.
And...No, if he's a mental patient which, by all appearances, looks to be clinically nuts. I doubt highly that's bedhead. He resembles a bust-out from NObama's neighborhood. Musta shot up his Flowbee too.

I Think the reason he should be fined and stuff is because of the irrational behavior he conveyed and the ownership of the weapon. But i don't really know what made him think shooting the lawn mower would make it run better....

All I can say is if I had to live with this cat I would hope and pray that he never got mad at me! But 10 years, I don't think so. Elvis did it all the time but then he didn't look like that! He looks a bit psychotic (dissheveled in appearance is a sign of that).

ok he was intoxicated when he did this. and the reason he shot it was because his lawn boy didnt show up so what would of happened if his lawn boy would have shown up while he was in this state of mind would he of shot him? talk about danger to society and if someone in his house reported him then there had to of been more to leading up to him just shooting his lawn mower. dont cha think?

Yes he has every right to do this and I think that the law is taking it just a tad far with that. I hope he takes it to trial and wins.

It depends on how many acres and how rural you are. If you have the space, shoot the hell out of it. If you don't have the space, take it to the local dump shooting range and shoot the hell out of it legally. Be safe with guns but have fun.

Unfortunately, the government has gotten far too involved in all aspects of our lives. Most places its illegal to fire a gun of any type within the city limits. In Tucson, destroying your own property, even without a firearm, is considered Domestic Violence & the person WILL be arrested! (Personally I think that is just Wrong!) A guy bought a new computer & took a hammer to his old, crappy one, & a neighbor reported hearing a "fight" in the house. He was busted & charged.

If this guy was intoxicated, if the shotgun was illegal to begin with (ie:too short) if there were kids around, etc. Then yes, he should prosecuted! Otherwise, no.

That's ridiculous, I think I should be allowed to shoot anything I own, that's half the fun of owning a gun.

What if some person walked up to him and started yelling at him for doing such a thing? He could've gotten mad at them and shot them too.
