Why do people on the witness stand have to tell "the truth, the whole truth, and nothing but the truth" but lawyers are allowed to lie and deceive all day long?
The average person is supposed to remain civil while lawyers are expected to act and be highly political. Unlike the doctrine of discovery which favored Christian rule/ruled, we now live under the often unwritten doctrines of financialization which favor the rich or well lawyered above all else in court. Heh.
Jeez I can't believe I'm going to defend lawyers here but here goes, they are not the ones on the witness stand and therefore haven't taken the "truth oath" during A trial.
The job of the jury is to decide who is the better lawyer. Been a witness in a Civil Court (Oxy?) and when in session the attorneys were cats & dogs, when on recess they were civil & jovial, they're bloody (good) actors. I rest my [brain]case.
Oh jeez - I should have known this would be yours - people on the witness stand are testifying under oath - the lawyers are not allowed to lie, though some do, and the lawyers are (generally) not witnesses. Your questions are routinely full of untruths and oversimplifications. You've got nothing unless you appeal to the uneducated and ignorant and willfully stupid.
Just like the formerly sovereign Nation of the USA, jurisprudence teeters on the edge of obliteration as well. When the rule of law is so blatantly ignored or obstructed as it is now courtesy of Obama's DOJ, it's just a matter of time (without intervention) when all bets are off.
ha ha... good question. I don't think they're allowed to lie. But they do get to withhold evidence in some ways. The lying is more akin to painting something in a way that isn't rational.... and the scary thing is, if they're people with the gift of the gab (as lawyers are) they can influence feeble-minded jurors into believing them.
Lawyers don't lie. They aren't allowed to. But~ That doesn't stop them from bending the truth so forcefully that even the person in question isn't even sure what they saw anymore.
"Anatomy of a Murder" was an example. Attorney would mention something that other objects to, gets sustained. Judge tells jury to "disregard & forget" statement. Clients asks the the losing lawyer about it, he whispers 'They DON'T'. Planting a lie.
