Walmart employees 'ripped up woman's $100 bills because they thought they were fake'

A mother who says Walmart employees intentionally humiliated her after wrongfully ripping up two of her $100 bills while believing they were fake is taking legal action against the store.

In her recently filed complaint, Julia Garcia is seeking no more than $74,900 in damages after detained for four hours before customers in San Antonio, Texas who were told she had tried to use fake money.

It was in the early hours of December 18, 2010 while doing some Christmas shopping for her children that Ms Garcia claims she presented the first $100 bill as payment before it was taken with suspicion from her.

    1. Let's acknowledge what the police even noted ..
    The $100 BILLS were legal tender .. legitimate .. and the store was totally in the WRONG
    2. The management of that store .. and the gossipy employees .. were in the WRONG when they 'labelled' her as a thief withOUT cause ..
    3. To sit there for 4 Hours .. humiliating enough .. then to have the snarling manager not even say 'sorry' .. or publically admit fault .. THAT is also disgusting and truth ..

    should this be a $75K case (with .. let's acknowledge here the attorneys will most likely scrape off at least 1/3 to 1/2 of the resultant award) ..
    Maybe not ..

    But .. no matter what .. Wal-Mart store at this LOCALE was completely and totally in the WRONG and should be liable for their abominable treatment of someone with LEGAL TENDER currency ..

    (Just noting .. I AVOID Wal-Marts at most times myself .. just not a good place at all)

    LOL...too funny! Walmart sells the counterfeit pens that retailers use to detect counterfeit money back in their office supply aisles. If I were her, I'd be suing for MILLIONS over the humiliation.

    If a store get's fake currency why on earth would they rip it up? Would they not want to save it as evidence? One more reason to despise sprawlmart.

    Lets see, wal mart and that woman are responsible for the money lost and the employee has committed a Federal Offense and this crime should be reported to the Feds. Also, who 'detained' her? That is a state crime, false imprisonment. Where were the police for four hours?? And if this is true, she deserves every penny.

    Why is she filing almost 2 years after the event? She got her money back, so I'd think a few hundred to improve her mood would be fine, but that's it. Does she think that Walmart's deep pockets entitle her to more?

    After all that, is does entitle her to more, and they probably have been trying to get a settlement that walmart ignored. Two years is the statue of limitations so the suit needs to be filed now.

    That was illegal on the part of those employees. The law states if you believe suspicious money is being used, immediately call the police and FBI. You cannot destroy money fake or otherwise.

    Yep. If it's real, it's a crime to destroy money. If it's fake, it's a crime to destroy evidence.

    When encountering what you think is counterfeit money....you call the cops or the Secret Service. YOU DO NOT RIP UP THE PAPER! Walmart should be getting sued for a MUCH LARGER amount! Management and EVERY employee involved in this should be fired and made to pay poverty-inducing (too them) damages!

    It seems like the only people that broke the law were the Walmart employees who "tore up" the legal tender! They should be prosecuted.

    She should get that and then some.

    Unfortunately.. Walmart has an entire law firm of their own, and this lady will die, or go broke in her own lawyer fees, before she sees a dime of any of her winnings of the suit, because Walmart will drag it out in appeals forever.

    That would be the reason for the false imprisonment charges, those are criminal charges when you hold someone against their will. And in San Antonio, four hours is not uncommon for a police response.

    I hope she wins maybe it will wake them up. I realize the stores are large and it is hard to deal with all the crime out there but Walmart needs to get over it and deal with the problems in a positive way. I recently had my cart grabbed right out of my hand by one of their security people and he was extremely rude. He yelled a me and said what do you have you did not pay for..is it electronics and I said I just paid for every thing I have here is the receipt. He would not let me leave the store until he went through everything and checked it against the receipt and he remained rude through out the entire investigation. It was humiliating and I shop there frequently for groceries. He jerked the cart out from under me 3 times and when he finally said ok you can leave (no apology or anything) When he finally allowed me to leave I said "Thank you for the great shopping experience at Walmart" He yelled at me again "we have lots of thieves"
    It was a really bad experience and if I see him at the door I now make sure that I go out the other door. I am a 66 year old grandmother with white hair and there is nothing about me that would make you say thief. He was out of line and I am tired of sending complaints to their headquarters. They have gotten too big and they have forgotten about the people that keep them in business.

    She'll get her money, no problem. But, she should have called me, I would ask for $74 million and settled for $25 million. It's always about the money!

    Does`nt surprise me, i once worked for Asda in the UK which is owned by Walmart. I was given some dodgy notes by a customer, i knew they were fake as they were the wrong colour !!, the stupid supervisor did`nt have a clue + gave them back to the customer !!. The management at these stores leaves a lot to be desired !!. They`re brain dead.

    Good case...hope she wins it all! ...False imprisonment and destruction of her property, plus I think there's a law about destroying legal tender.
    Walmart seems to be managed by the 'brain dead'.

    Not only is it against the law to destroy legal tender, it's against the law to destroy illegal tender.... it's destroying evidence. No reason in the world they should tear the money up.

    "You can't fix Stupid" what happened to the fancy pen they use? If they did that to me that checkout lane would be named after me and the clerk would be carrying out my shopping bags to my car (conveniently parked as far away from the entrance as possible) before they were fired.

    Clerk & manager were pretty dumb. I am really down on frivolous law suits but this one does not qualify as such. But I wonder how they arrived at $74,900?
