She could fight that. Undergoing SRS means she is legally female and has the right to use women's public restrooms.

She shouldn't have been ticketed but whatever. Those calling her a man are ignorant. If she's socially and legally a woman than she should use the woman's restroom (especially if she's had the SRS because that would be the only grounds that I could see any argument over but if she has a vagina now and no longer has a penis that that uncomfortable argument some women might use is now a moot point because she's like any other woman.... but if she still had her penis than I could see some concerns by some women who don't understand transwomen).

Under common law, was there any harm to anyone or anything? If there was, then charge accordingly. If not, then don't all of you who are criticizing this person have more important things to do?

HE! was in the womens restroom. The female who complained had no reason to know why he was there or what his intentions were. The ticket was justified.

Making other people fearful or uncomfortable is why it was arrested. Just facts.

Unreal. She should sue the police officer under 42 U.S.C. Sec. 1983 for violating her civil rights.

Although I don't doubt you, when the h*ll did criminal conduct become a civil right?
  • Joanie Charles E 2012/05/05 21:35:42
    Joanie
Criminal conduct is not and never became a civil right. What this woman did, however, is not criminal conduct under the Texas statute. In order to commit disorderly conduct under the Texas statute, the person must have had acted intentionally or knowingly for a lewd or unlawful purpose. There was absolutely no evidence that this woman had a lewd or unlawful purpose in entering or being in the bathroom. Hence, she was arrested without probable cause to believe that she committed a crime. And it has been a civil right not to be arrested without probable cause since the formation of our republic.

Girls restrooms can be gross as well. I swear, some women's stalls look like someone beheaded a cow in there. Yuck.

Woman in the womens bathroom. Finds herself with a GUY!
Uncomfortable at best. Wondering WTF is going on.
    Not wrong to be concerned.
Absolutely not mean to demand that a man not use the womens bathroom!

It is a bold faced lie that you can change your gender.

Since we have these weird effing people running around the world, unisex, single user restrooms are necessary. Hell, that's what they have in most medical facilities now anyway.

So you think we transsexual people are weird, huh? And we should have to have separate public bathroom facilities? Should we go back to "colored" and "white" bathrooms to placate the racists who think you are weird?

Having single user, unisex bathrooms isn't descriminitory. In fact, that's the most inclusive type of restroom. Again, most medical facillities have bathrooms like this now anyway.

Your position reminds me of the position of the certain segregationists in the south who, when confronted with the law which prohibited exclusion of blacks from the public swimming pool, closed the public swimming pool rather than be in the same locker rooms with black people.

I still don't see what's wrong with having unisex, single user bathrooms. It eliminates any and all questions as to who should use what bathroom.

The racists in the south used to say they didn't see anything wrong with closing the municipal pool. It eliminated all questions as to who should swim with whom.

DAFUQ, that's not the same thing! Please, tell me SPECIFICALLY what is wrong with single user bathrooms? Quit comparing them to other things because that isn't an argument at all.

i would have thought by now, that as a society we had evolved beyond the petty idea that men and women aren't able to use the same rest rooms in an adult, non sexual way. apparently the majority of people in this country are still children.
