In 1999, an auction for a "fully-functioning" kidney showed up on eBay
starting at $25,000. The final bid was $5,750,100 before the auction
was cancelled by eBay.

The National Organ Transplant Act, 42
U.S.C. § 274e (2002) (NOTA), enacted in 1984, makes it a federal crime
to "knowingly acquire, receive, or otherwise transfer any human organ
for valuable consideration for use in human transplantation if the
transfer affects interstate commerce." Violations of NOTA carry a
$50,000 maximum fine, a maximum five-year imprisonment term, or both.

Every year, thousands of people die while waiting for an
available
kidney or other human organs. An ongoing debate is whether it should it
be legal to sell your own body parts, either before or after your death
by your surviving family members?

    Alot of people arent donating. Throw some cash in there and they would change their minds. I dont think it would hurt the donations upon death.

    Sure, but then would it be legal for someone to buy them for consumption, art, or other reasons than necessity?

    Would we have rich cannibal's bidding over a good liver to eat when someone else needs it to live? haha ridiculous.

    I think it would be wrong for your family to sell your organs though. #1 - they'd kill you for your organs #2 Body parts of the dead should be left to the hospital to determine who needs it the most - but body parts of the living should be fair game if you want to suffer the removal process.

    Umm....the rich are the only ones that get organ transplants anyway. Mainly due to the high cost of surgeries that exceed what most people's insurance will pay out. Doenst matter if you're poor and have a donor you wouldnt be able to afford the transplant anyway not without being miserably in debt which case you might as well as be dead.

    It's my body and I'll do what I want with it. If I die and my family sells my organs to help them get some income, I think they should do it! It would help them and it is not like I need it.

    People do it all the time. that's why there's a two year clause on life insurance. People do desperate things in desperate times. Don't you worry that if it became legal to sell your organs that only the wealthiest could afford transplants?

    Most people really can't afford transplants already. There are an innumerable amount of procedures that are not affordable to general public. One of the main reasons for people in America to go bankrupt is because of medical bills. If it is something becomes legal they can make it a law where organs cannot be sold to individuals, but rather companies or hospitals that will give the organs to people who really need and deserve it. There are many factors to consider.

    I find it somewhat amusing how the government tells us what we can and cant do with out bodies. My friend is 25 years old and living with 70% kidney failure. Been living with it for the last 4 years. Until recently, he was going through dialysis 3X per week for 3 hours per visit. If you ever knew anyone who goes through dialysis, its a draining process that leaves you battered for the rest of the day making most simple tasks extremely difficult. He's been on a transplant list since the start of this ordeal and things have only gotten worse. The hospital has recently given him a home dialysis machine that he now does 6 days a week. He cant keep a job, and barely keeps up with a light school schedule. His life is at a hault until his condition gets better which will only happen from a transplant. Now, because he's not seconds from death, he's nowhere close to getting a transplant. This condition is killing him and it will only get worse, yet until he's knocking on deaths door, he'll never get the transplant. Make sense? Instead of giving him one now instead of to someone whose life might only be prolong by a few months, he's losing out on the best years of his life. How awful!

    Only i can sell my body parts. I don't need my family and friends distributing pieces of me so that they can live in lush luxury. Screw that. But if i want to live in luxury with one kidney or one testicle. Why do you care? Its my testicle.

    I feel that you should donate your body parts as your final good deed to help others and not because you would profit from it. There are a lot of people on the waiting lists for organs and therefore we need to do more to increase the awareness of this and to let people know what they need to do to make sure that they become a donor when the time comes.

As much as I love my loved ones, I could NEVER afford to purchase an organ for them at that price and neither could 98% of the population. If they were to allow people to sell their organs, only the extremely rich would be able to afford to get the organs to keep their loved ones alive?! That doesn't make any sense to me at all!!! And if I were losing a loved one because someone had more financial resources than me, that would be very painful, not to mention the anger that you would feel!
    Opening the door to selling organs on your own through E-bay is completely the wrong answer and would only open the door t...

    Again, I feel that people should do good deeds without monetary incentives. However, since this is not always the case, a possible scenario that might work would be if the hospital or government would offer a certain dollar amount given to your family upon the successful transplant of your organs as long as the organ donor (not the family) followed the proper procedure to become a donor before their death.

    Increasing the awareness is the answer!

    Yes. We live in a (somewhat) free market society. This should apply to organs as well. If someone wants to pay 5,000,000 for a kidney, so be it.

    What if your child needed a kidney, but you were outbid by a 95 yr old billionaire who would use it to extend his life one extra year? Would that be a reasonable trade off?

    Allowing people to sell organs would make a person's monetary status the deciding factor for whether or not they get to receive an organ. That could leave many people much more deserving of the organ left for dead. Should a billionaire alcoholic be allowed to buy a new liver every time he drinks his way through one? Or should the liver go to an otherwise healthy teen who's liver has failed from other causes?
