Should a person be sued because they send a Text-Message to the driver who crashed?

    How the hell is a person supposed to know if someone is driving? And even if I know someone is driving, if I send them a text, it is NOT my fault if they decide to read it and in turn get into an accident.

    The driver who answers the text while driving is the main one at fault.

    The sender had no way of knowing what the recipient was doing at that time.
    The recipient was the one who chose to read the text instead of driving!
    AND the benefit of texting is you can wait to read the message, unlike voice calls which may be lost if not answered.

    i text people all the time and it is their responsbility to knw when they should be texting and when they should not be not mine

    The driver should not be receiving text while driving, so the responsibilitie lies with the driver.

    It was the drivers responsibility to use common sense and not pick up the phone. When will people take responsibility for their own actions?

    The driver who crashed shouldn't have been checking text messages while driving.
    If they do it's their fault not the senders, most senders don't know what the recipient is doing at the time they send. People need to use some common sense.
    If the court goes through with this stupid case it makes a case for no more texting people.

    Sending one to the driver that crashed is not a reason for suite. I may choose to sue the person who responds to that text while driving and hits me.

    Yes, she knew he was driving when she sent those text messages. But it's still not her fault he decided to read them while driving. HE broke the law, HE caused the accident, when HE left is lane because HE was not paying attention

    First of all how would they know that receiver of the message is driving and two the driver does not have to pick it up. It is not like a phone that rings and rings. A tex message is just one little ding. The driver should have his cell phone on vibrate and should have waited until he is stopped at a stop light to look at the message.

    The person who was driving the car and answered the text and crashed the car is the responsible person. Nobody should be using their phone while driving.

    In many states you can't even talk on a cell phone and driv let alone text, to text or try to read texts is pure stupidity and the person doing is it has a selfish disregard for everyone else on the road. Besides that, how is the person texting the driver supposed to know what that person is doing?? The crash is the responsibility of the driver, if the driver had any common sense he wouldn't be trying to deal with the phone while driving.

    Our society is sue-crazy, looking for a fast buck. The lawyers who take these cases are back-store ambulance chasers and the judges should throw them out of court

    The person just sent a text. The driver, as far as I know, wasn't being held at gunpoint and forced to answer the text. He chose to text and drive, which resulted in an accident. It's not that person's fault the driver has no common sense.

    It's the drives option to check their phone. It's not the senders fault, their friend was idiot and checked their phone.
