Santa Monica Proposes to Ban Smoking in Apartment Rentals: Do You Agree With the City's Proposal?

The city of Santa Monica recently proposed to ban smoking for new apartment and condo renters. Under the proposed ordinance, both new and existing multi-unit buildings would be subject to the ban.

Smokers already renting could continue to light up in their apartments, but the units would be covered by the ban as soon as they became vacant. According to the Los Angeles Times article, "Tenants who break the rules could be fined up to $500 if a landlord or a neighbor takes them to small claims court."

LATIMES.COM reports:
The Santa Monica City Council is scheduled to vote on a plan to bar new renters from smoking inside their apartments and condos. The council should demonstrate restraint and vote no.

    I am a non smoker and even I am sick of the government sticking their noses where they don't belong. They had no right banning smoking in private businesses and they have no right banning smoking in private property. If We the people do not stand up to these politicians at some point, and that would be NOW they will just keep STOMPING all over our rights. Today it may be smokers tomorrow it will be you "yes people"!!!

    Shouldn't that decision be left up to the owners?

    I can see dozens of discrimination lawsuits just waiting in the wings.

    I agree that it's not their home in the sense that they do not OWN it. However, a rental agreement usually contains a "quiet enjoyment" clause which, in a sane world, would include smoking (how much quieter can you get?). Obviously, we don't live in a sane world or a free country for that matter.

    Tell me, when a lease or rental agreement is broken, why is it so hard to get someone out. If it says no smoking on the agreement, but they still smoke, just try getting them out. if they don't pay the rent on time, try getting them out, if they don't pay their garbage bill and a lease is put on YOUR property because of that TRY GETTING THEM OUT.

    There are doing it now In some places you can not even fly the US flag. on your own lot. But the wet backs can fly theirs any where.

    They pay to live and are allowed to smoke a legal product. If you are the one who has such a problem find another place to live.Your rights are not over anyone else.

    Are you really that stupid? They have a rental agreement. It IS their home. They are paying for it. They have a contract that allows them to live there. That is like saying when someone goes to buy a car, until they have paid it off, it is not theirs. btw - smoking does not actually increase your chances for lung cancer. that is based on a 1993 study that even the SUPREME COURT said was biased and inaccurate. GROW UP and GET OVER IT.

    LEt me know when they clear up the air first before they even try this crap. IT is always easier to beat up one person as we see here. BUT to take on all the polution I see they back down.

    I don't even smoke, never did. lol BUt I left CA long ago over that pollution. I have lost three cousins since then, and guess what, They never smoked either and died of lung cancer. I lived in the mountain area and every morning I would wake to see LA just covered in it. IT would take hours for it to burn off.

    I have laways found it hiliarious that some ass would tell of a lone little smoker about her ciggs, but not a word to some BIG TRUCKER who just spewed all his smoke on them. Seems they only have balls for the little guys. LOL Years ago filters were made for those factories, but not enforced. Too bad, and the same goes for the gas industry.

    And yes it seems we agree again. EGAADS. LOL

    I've had people in the middle of Manhattan, surrounded by hundreds of cars spewing tons of pollutants whine about my cigarette smoke.

    Thanks for the info on Bobby McFerrin, and I can remember standing at some dump where a bunch of tires had caught fire and was burning for WEEKS and some nutball asked that my boyfriend at the time put out his cigg, it was bothering her, LOL and not one word on the stink coming from the tires.

    I am hunting for this one song that I know you will love, mmm when I find it I'll play it for you.

    TO;C.C. - Great Photo's! Again...Why is the government worried about a cigarette? Burning (weeds/stubble off) a farmers field before planting is normal. Would the farmer be allowed to burn off his tobacco field?

    For there to be a ban to stop smoking in rented apartments, you would need to stop smoking in owned condos, rented houses, and owned houses. This is just another right that the government is trying to take away from the public. I think that it is your home and you should be able to do anything that is legal outside of the home, inside of the home.

    You can't smoke at work, at a restaurant, in a park, in so many places. Restrict smoking in your home?, in your car? Make the damn things illegal just to please you and the other busy-bodies. See how that works.

    Possibly consider smoking floors or in the case of Condos, segregated buildings, smoking vs non smoking. My friend's neighbor smokes and the smell reeks in her Condo, in her clothes, etc. It would appear that this is an absolute case of second hand smoke.
