The Global Commission on HIV and the Law issued a report suggesting that nations eliminate laws banning "consensual sex work" -- i.e., prostitution. It's an interesting claim coming from an organization aimed at preventing sexually transmitted disease, but their hope is that legalization would lead to regulation and safer practice. We asked the public if prostitution should be legal.

Nearly two-thirds of the population admitted that it thinks prostitution should be legal. However, it's important to understand that this doesn't necessarily reflect the public's moral opinion of the topic. The question is explicitly legal. Most people think it should be a choice. One commenter wrote, "By legalizing it, mandatory health screenings can be required for the safety of the prostitute and the buyer. Trying to keep it illegal only keeps the thing in the dark where roaches like to live. Bring it into the light of public attention and those roaches will scurry."

Men Are More Willing

Should we be surprised that men were more likely to support the legalization of prostitution? Of course, the Global Commission was not referring solely to female prostitution, but it is more often thought of as a service targeted at men. Actually, the difference wasn't that big. Men were only 11% more supportive than women. Women were still more likely to support legalization than refuse it.

Christian Resistance

Religion and politics provided the biggest defenders of criminalization -- Christians and conservatives. Both demographics were significantly less supportive than the rest. Since religion and politics are often closely related, it's probably not too much of a leap to assume that religion drives this one. Allowing the nation to embrace something that Christians consider to be immoral is a tough call to make.

Older Voters Are For It

Typically, older voters respond similarly to conservative voters. In this case, that means we would predict the older a voter got the less willing they would be to support the legalization of prostitution. Not so. Actually, most age groups were relatively similar. The only one that stood out noticeably was the 55-64 group, and they were 11% more likely to support legalization.

    Seriously Christians, you see transactional sex between two consenting adults as worse then the rapes, abuse and murders that you are allowing to happen by keeping it illegal...

    Women in sex work cannot go to the police about rapes or abuse because of their profession and that is plain and simple WRONG.

    Right...that'll stop those who have no intention of paying or following the law in the first place! Do you really think a rapist cares if prostitution is legal? Is his decision to rape based on the legality of the profession of his victim? Rapists, for the most part, don't go out of their way to plan, strategize, organize and execute their crime. When the opportunity presents itself, they attack. You're suggesting we open the flood gates of opportunity! Brilliant!

    I concede, beaten and ashamed by your unsupported opinion. Before I leave, however, I must ask just one more question. If you would be so kind as to answer it, maybe I can begin to "get it".
    Since prostitution is sexual harassment, rape, battering, verbal abuse, domestic violence, a racist practice, a violation of human rights, childhood sexual abuse, a consequence of male domination of women and a means of maintaining male domination of women. How would legalizing prostitution change prostitution beyond making it legal for women to be victimized?

    it isn't to me at all, male prostitutes are quite common here, but when they did a survey of the sex workers before the legalisation they found that male prostitutes didn't have as many problems with abuse as the female prostitutes did.
    thats why i didn't outwardly mention them.

    Do you seriously believe that rape abuse and murder will go away if prostitution is legalized. Rape is a crime of violence, not a crime of sexual passion. It results from a deep seated hatred for women and a desire to hurt them.

    She's not saying they will go away, she's saying it'll make it safer for the people who choose to do it. It'll be easier to crack down on trafficking and exploitation. Less men, women and children being harmed.

    I was a prosecuting attorney for many years and taught criminal law. In hundreds of cases, I saw sex workers arrested and prosecuted for their profession when they reported being the victim of a crime.

    I cannot, however, remember a single incident of a "john" being prosecuted for anything (even drug possession). The police just laughed it off and the prosecutors let them get away with it.

    Can you give any examples of an abusive john being prosecuted?

    That's a whole different issue. "Promoting prostitution" is already a crime, even in states with legal prostitution. "Forced prostitution" is a form of kidnapping and a possibly a form of slavery, both of which are illegal.

    I'm neutral on it being legal or illegal and I also don't want to descriminate prostitutes but what do you expect by being a prostitute? That your buyer will love you with his heart and go easy on you?

    In brothels it is discussed before hand, usually with a madam or pimp, what the customer wants and a contract is made, so the sex worker knows what they are getting into and can take the client or not depending on what they want, a breach of contract in our courts is treated as any other breach of contract, rape is when the client does something without the sex workers consent, abuse is not tolerated for a second, even sex workers who are professional subs cannot be beaten.
    It isn't about love, its about respect of a human being and safety.

    Wrong, a lot of Christians don't have such viewpoints, please think before posting. And women usually aren't forced to do sex work, at least not here.

    Ture that about "chirstian" folks like me. But we do understand that the profession must exist to help reduce work load on the police force.

    and yes i do agree that all rapes need to be treated the same way. Its just police don't go down that path because evidence could be "confussed" unless the acussed confussed to the crime.
    problem is it is a very delicate thing to tamper with. but yes none the less it must be delt with.

    Legalizing prostitution will not stop the rapes, abuse, and murders towards prostitutes. They will still face the danger of getting killed, raped, abused because most of these prostitutes don't have relative to depend on and support them to go through school and better their education. It's not worse than what goes on out there, but it's in the category of things you shouldn't do. Their profession doesn't stop them, there are helps for prostitutes out there. Prostitutes can't go to the cops because they are threatened not to do talk. It's wrong because women should not giving up their body for sex with filthy men, who thinks they can do anything they want to these women because they are paying them. To me, legalizing prostitution is like saying it's okay to treat these women like crap, there's help out there for them, but it's still okay for the men that controls them to keep them fear of speaking to anyone and take the money they earn away from them. Prostitution smells of slavery to me.
    Christians are against this, not only because it is wrong, it is because these are disrespecting their bodies and why do they have to stay in that condition and suffer abuse? Before you go against Christians, you should understand why they are against certain things like abortion.

    You know brothels are also used in sex trafficking and how this brothel is displayed is not the condition the women live their lives. Most of the time the women are threatened and so therefore they can not talk. They are beaten and abused daily behind the closed doors. That brothel might look nice on the surface for visitors and customers but they are also back rooms that are in terrible conditions.
    Prostitution is not just prostitution, it is connect to the second most criminal activity in the world....HUMAN TRAFFICKING!!
    Legalizing prostitution is like making human trafficking an even more tough industry to beat. It will open the door to many bad things.
