A lady bought coffee at a McDonald’s drive-through, spilled it on herself, and suffered minor burns. She sued McDonald’s, and with the help of a clever attorney, managed to convince a jury that it was all McDonalds’ fault for not providing adequate warning that hot coffee is indeed hot, and can scald you. The lady walked away with a multi-million dollar award....

    That's not the whole story. She didn't suffer minor burns, she had to get a skin graph. Everyone who says it was her fault should watch this.

    I agree the woman should not have been opening the coffee between her legs...
    I mean DUH...accidents can happen and what a body part to risk being burnt, but what if she had merely taken a drink ? Would she have burnt her throat and that cause her to
    drop it in her lap as well ? McDonalds had fault as well...her burns would not have been so debilitating if the coffee was at normal temps.

    A lady spilled hot coffee on herself in her car after leaving McD & sued for $13 million & won several years ago. There will be more copycats.

    This is why McD now has cup operating instructions on it's coffee cups. You can even go on line & print a 130 page instruction manual on the safe operations of a coffee cup. This is what lawyers have reduced society to.

    It cost taxpayers $100s of millions to do a servey, reserch, design & produce a 130 page training pamphlet on how to use a coffee cup. Your tax dollars at work.

    And just think, if McDonalds had settled out of court for the
    $20,000 the lady originally asked for, none of this expensive
    litigation would have been necessary.

    i think the reason she was able to sue is because the McDonald's employee didn't put the lid on properly,but still,we all know coffee is hot.
    I'm not mad at her for suing though.McDonald's has been poisoning people for years.Who cares if they had to pay someone.It didn't hurt them and she'll probably spend a portion of what she was awarded at some McDonald's anyway.

    When you buy a hot cup of coffee, it should be evident that it is hot. What you do with the coffee after you buy it should be your own responsibility. She put a hot cup of coffee between her legs and is surprised when it burns her. She won the lawsuit. Does this tell you how messed our justice system is?

    Actually, it's one of the problems of the judicial system which allows such frivolous law suits with astronomical remuneration. The only way I would say that the woman was blameless would be if she had never heard of coffee before and was trying it for the very first time and had no idea that the beverage was hot. Even my three year old granddaughter knows that coffee is hot.

    This incident happened years ago and that is why coffee containers now have warning labels on them about the contents being hot as do the hot apple pie boxes. I'm surprised that soda cups don't have a warning about the contents being cold because they contain ice because it could be said that really cold beverages spilled on someone with a serious heart condition could be a danger. Oh, oh, I might have just set a restaurant up for another frivolous law suit. lol

    My opinion is the same as always, put the idiot woman in a padded cell and feed her nothing but jello in a rubber cup, that way she can't hurt herself with food ever again. The same moron would have complained had the coffee not been hot enough

    I'd say its a little of both. McDonald's shouldn't be serving coffee so hot it can cause burns and the lady should be more careful when handling anything that could injure her or stain her work clothes.

    I studied this case in my torts class in Law School. The plaintiff, a 79-year-old grandmother named Stella Liebeck, was not driving, nor was the vehicle moving when the injury occurred. While the car was stopped, Mrs. Liebeck, who was sitting in the passenger seat, tried to hold the coffee cup between her knees as she removed the lid. The cup tipped over, spilling the contents into her lap.The lady was elderly, and the coffee was hotter than the standard norm of 135 to 140 degrees. The lady's injury was anything but trivial. The scalding-hot coffee caused third-degree burns over 16% of her body, including her genital area. She had to be hospitalized for eight days. She required extensive skin grafts and was permanently scarred. She was disabled for a period of two years. During the ensuing trial, Mrs. Liebeck’s physician testified that her injury was one of the worst cases of scalding he’d ever seen.

    The coffee. At the time, McDonalds’ corporate specifications explicitly called for coffee to be served at a temperature between 180 and 190 degrees Fahrenheit. An expert witness testified that liquids at this temperature will cause third degree burns of human skin in two to seven seconds.

They also awarded $2.7 million in punitive damages, essentially as punishment of McDonald’s for its callous treatment of Mrs. Liebeck, and its years of ignoring hundreds of similar injuries.
