If a doctor misdiagnoses you against your information and almost kills you with medication, should they be charged as though they assaulted or attempted to take your life?

Yes. If they hurt you that's a crime.
No. Its your fault for listening to them.

Doctors are known for going against the patient's intuition and prescribing the wrong medication for the wrong illness. Many people have been hospitalized, disabled or even killed because of misdiagnosis. Part of the reason why malpractice is so high is because of the large frequency of these events. Should doctors be charged as though they attempted to kill or assault a patient if they do not listen to them correctly, and misdiagnose their illness leading to hospitalization, disablement or death?

There are so many brilliant Doctors out there who will do anything so they don't miss anything out... if I know that this Doctor has done his/her best to help me then I would not see it as an assault on me.

On the other hand there are some very ignorant "Doctors" who will ignore anything you say because they have this stupid idea that they know everything and will just give you some pills to get rid of you where you may be in need of hospital treatment. In that case I would sue that pants of that Doctor, even more so if a loved one was involved.I would not rest until that person was brought to book.

I've worked with a lot of doctors who have a complex which tells them its okay to experiment on people. They see people as lab rats who are there for their own testing. Usually people who have pains that are hard to explain are quickly disregarded and written off as drug seekers. Ironically, the doctors will prescribe them alternative drugs and do not address the real underlying illness. This has been well documented in the medical community but most cases are not reported to the news stations because they don't want people to attack the drug companies for their involvement in the situations. They are paid by pharmaceutical companies to report information about the drugs they are passing out. They are paid to use drugs as an alternative to positive treatments such as massage, psychotherapy, physical therapy and nutrition.

We should also keep in mind that insurance companies have designed our medical system around life-saving treatments rather than preventative medicine. Often drugs are prescribed because they can mask your illness for a long time until begins to kills you. Then, surgery is used to perform a life-saving procedure. We should also keep in mind that insurance companies have designed our medical system around life-saving treatments rather than preventative medicine. Often drugs are prescribed because they can mask your illness for a long time until begins to kills you. Then, surgery is used to perform a life-saving procedure. This insures the highest profit yielding situation for the insurance companies. Doctors, especially in hospitals, are told when and why they can perform procedures based on statistics provided by insurance companies. If you go to them with vague symptoms, they will usually tell you to wait until it gets worse because insurance companies don't want to back up doctors who charge too much money on insurance accounts. Insurance companies pay a percentage of patient's procedures and lose money every time a patient receives healthcare. This is why they are so hard on doctors in these vague situations. This situation is most evident in cancer patients who have been victims of this situation in countless cases leading to disability and often death.

I blame the doctors for their participation in this situation because they swore an oath to help patients. I gave the same oath myself. If a doctor goes against your information it is because he is looking out for his own financial situation and should be charged severely with a crime and labeled as a criminal. Its amazing to me that if you assault someone on the street you are a criminal but if a doctor goes against your information and hurts you with medication they are not. I think we should change that.

It's called "malpractice" and that's why doctors pay insurance against it.

That's what we get for not getting a second opinion. Doctors are usually guessing as to what is wrong with you. They do their best. Accidents happen.

Are you talking about the pharmacy getting the drugs mixed up with another one or the doctor just prescribing you the wrong meds or dosage?

    +1
The doctor giving you the wrongs meds or dosage yes. Usually based upon a misdiagnosis. Not the pharmacy.

For some people they would like to have them arrested but really all you can probably legally do is sue them.

Once they are government officials I would expect that there would be no right to sue for damages. - I do not believe that criminal charges would normally apply.

There's certainly room for a malpractice lawsuit, but criminal charges?

    Be serious.

I don't know a single doctor who would attempt to hurt anyone.
