Ok here is the situation. A few month's back I was working and was on a return trip from a hospital. On the way back my ambulance was struck by a trailer that had came loose from a passing vehicle and knocked my ambulance on it's side at 55 mph. Both me and my partner where treated for minor injuries and release from hospital's. 3 months after the accident I am still off of work becuase my neck will not quit spazing and so is my partner myself nor my partner have never had any major medical problems until this. Long story short for me I had everything going in a positive direction I was 16 class's away from becomeing a paramedic I had just got my house payment lowered and was current on that. Now becuase I have been off of work so long workers comp is only paying me 66% of what I make I had to drop out of paramedic school becuase the instructor would not accomodate my work restrctions and all my bills are starting to get behind. Anyway I had mentioned to a family member that I was thinking about filing a personal injury clam aginst the guy that caused the accident. Mainly for the fact that the State Highway Patrol found him neglagent and sited him for being left of center and he does not want to own up to what he did and is trying to say I was at fault even though I was in my lane. So my question is simply this:

IF YOU WHERE IN MY SITUATION HOW WOULD YOU FEEL AND WOULD YOU DO THE SAME THING AS ME AND MY PARTNER ARE?

    I believe that if the State Patrol found him negligent, then he was at fault and his insurance should be helping with rehabilitation to get you back to work and school. This is absurd that you are now disabled and can not continue with your life!

    His insurance company tried to contact me like two days after the accident. It was a good thing I told them that I had a attorney, becuase I have been off of work now for over 3 month's. Plus a month after the accident the found a fracture in my neck at the T1. As far as the school goes well I am not sure what will happen with that, becuase they wouldn't let me stay in the class I was in but was more than willing to let me go all the way back to week ten. Which if anyone knows about EMS schools paramedic school is alomst two years long and I was due to graduate the school on 8/2/2012 that's how close I was. So from a money stand point I am not sure if it's even worth my time or if I should just go on to be a RN after this is all said and done.

    Good luck to you, and I will keep you in my thoughts and prayers for a complete recovery and for your career to get back on track. You did not mention your age, but if you at all can, go for your original quest, there are not too many things I regret, but not doing what I really wanted to do is one of them. Totally different circumstances, to be sure, but outcome was that my dream did not get fulfilled. Any one that can in any way fulfill their dreams, it is, for me, a really big deal to try to get them back on track. Good luck.

    You need a good Workers Comp attorney as well as a PI attorney. Furthermore your employer should be going to bat for you with Workers Comp. I would get the case reviewed by both and look at my options. If everything you have stated is factual then you have grounds for PI and I'm suprised your employers insurance hasn't pursued that avenue as well as subrugation for damages to his unit and equipment. Your employer may not be being honest with you as well.

    They have already gotten this unit replaced. It was replaced like three days after the accident. I do have a good workers comp and pi attorney trust me on that. As far as my employer going to bat for me well I am not sure what they are thinking to be honest.

    Leave it up to the lawyers. And if they are competent I would expect them to hold your employer accountable and draw them into the mix.
