    Unless you are driving commercially, the cops have no jurisdiction over your common law rights! They need to leave you alone!

    I agree! The cops are thugs!!! Everyone needs to understand their common law rights. The thug cops have ZERO jurisdiction over peaceful sovereign beings!!!

    i was stopped for a busted taillight one time, and the cop wanted to search both me and my car because i looked like a punk. "i was coming back home from a concert" i told him i don't consent without a warrent, and he tells me to step out of the car, cuffs me, then throws me onto the hood of his patrol car while he talks to command. he eventually leaves me with a fix-it ticket and orders for an attitude adjustment.

    Only once and I think it was because he saw the anti-war stickers on the back of my truck and assumed I was a youngster and was probably carrying pot.

    I told him no and asked him why he wanted to, he couldn't give me a straight answer. When he said he was going to "call in the dogs" I told him - in my most authoritative voice (my father was an army sergeant-cop and I learned from him) - the only way I was going to stay was if he arrested me and he better have a damned good reason for doing that.

    It was then I think he realized I was not a youngster and not so easily intimidated, he backed-off and left.

    Never had the Police to my home except to get me to sign a warrant for them....never mind search.

    You cannot refuse a search of your car in Scotland once you have committed a driving offence. Probable cause for a search extends to the officers individual discretion, In fact trying to prevent a search is a public order offence, which in itself is grounds for a search. However it does require corroboration which means two officers have to be present.

    Your house is a totally different matter and requires a search warrant, without it any evidence found would be inadmissible in court. I know this as I originally took a LL.B law degree in university, before I changed course :)

    I have had a cop try to talk me into letting him search my vehicle after I denied him. he threatened to bring out the K-9s and everything.
    so I told him:

    First of all, I wouldn't ever deny a search. Why should I? . . . I would never refuse a Drug Test, either. I do NOT have to Take an Oath, in order to proclaim that what I am going to say is going to be the truth; but if it is requested of me to be administered an oath, then I shall NOT ever refuse it.

    If you don't stand up for your Constitutionally protected rights, you won't have them. Not only that but refusing to protect your rights and the rights of your fellow citizens is a failure to live up to your responsibility as a free citizen.

    Can't say I need to any more, but as a young kid that cop just 'knew' I had drugs in my car. Letting him know that I did not authorize and reminding him that his camera caught it, he backed off.

    I have had one ask me, however I asked to see his warrant signed by a judge and he lost interest in looking inside.

    It was a mistaken identity case, the cops got a tip about drugs at a home, but, the police came to the wrong address. (It wasn't even on the same side of town I lived in at the time)

    An officer asked me if they could search and I asserted my rights and asked to see a warrant. They tried to "threaten" and "bully" me about how tough it was going to be on me because I didn't cooperate with them, they even went so far as to imply that I might get hurt for "resisting" (I wasn't resisting, I was only asserting verbally). I told them over and over, that "I do not consent to a search of my home". I was so loud that my neighbors heard what I was saying.

    The police sat in front of my home while they where supposedly getting a warrant and after about fifteen minutes a police supervisor pulled up, came to my door and apologized and told me about the mistake and for me to have a nice day.
