Employer Asked Woman to Wear Mini-Skirts on Mondays: Should She Win Damages?

A Utah woman has sued her former employer for sexual harassment, claiming he asked her to wear a variety of sexy outfits on each day of the work week, The Salt Lake Tribune reports.

Trudy Nycole Anderson, 44, says she was told to follow the following wardrobe schedule, according to a civil complaint filed in U.S. District Court:

--"Mini-skirt Monday"
--"Tube-top Tuesday"
--"Wet T-shirt Wednesday"
--"No bra Thursday"
--"Bikini top Friday"

Our first question: Who wears a tube top to work?

Anderson worked as an office manager starting in September 2007, and Derek Wright, owner of Pleasant Grove-based Lone Peak Controls and D and L Electric Control Company, was her supervisor, according to the Tribune.

Wright "repeatedly asked Ms. Anderson about her breast size and talked about her breasts in front of other employees," the complaint states.

He also allegedly asked her to show him her breasts, slapped her on her buttocks and asked her for sex on several occasions, the complaint states.

Perhaps most serious, Wright brought Anderson a document in 2007 stating that she would agree to allow him to sexually harass her, according to the complaint. If Anderson didn’t sign the document, Wright told her she would lose her job.

Anderson claims she reported the sexual harassment and Wright retaliated by firing her in February 2011, and now she's seeking unknown damages. Should she win the case?

    I am always amazed that people are so stupid, rude, or oblivious to the responsibilities of position. When I was asked by (male) sailors in my various commands how to interact with their female counterparts without their actions being misinterpreted as sexual harassment, I gave them two simple rules--1) consider how they would like their sister or their mother to be treated and 2) always be professional. For leaders--always treat subordinates with respect and any social interaction, which might be considered coerced because of the supervisor's position of power is completely off limits. I really don't think this stuff need be all that difficult.

    not sure if im reading this correctly but she waited 4 years to report the harassment, and only after she lost her job? im not saying no harassment took place but letting that go on for 4 years instead of filing the complaint then or starting the process to find a new place of employment just seems like a ploy to hit the blue collar jack pot, sounds a little bogus imo or a bad joke gone terribly wrong, not to mention that note would have gotten that guy fired on the spot, i mean really, wet t-shirt wednesdays? gimme a break

    Not sure about being awarded damages. But the question itself is misleading.
    No rational boss would ever ask for some of the things listed in the "story", specifically anything listed beyond Monday.
    Could be a really piss poor manner of flirting!

    Firing is, however, unwarranted!

    i am a father of 4 daughters . to me it is much more important that my daughters are doing something that they want to do and like to do than what they wear while doing it . what exactly is wrong with wearing a mini skirt ? since when does what a woman wears have anything to do with who the woman is ? all of my daughters and my wife have worn mini skirts on many occasions . the problem isnt what clothes a woman wears , the problem is the sexist , judgemental , closed minded people who demean women with irrational , sexist thinking.

    A great many opportunistic people these days, once they see an opening in Law ... and the openings are certainly there for women these days - because of the momentum in law, often with little proof!!LOL!
    So we would just need to see which way the case goes.
    The whole claim that this even happened - esp via some proposed Contract, sounds very suss to me!!

    Although she should have filed suit when he threatened to fire her if she didn't agree to allow herself be harassed, he probably knew she wasn't likely to stand up for herself and that she couldn't afford to lose her job at the time.

    Used to be you didn't like your boss, you'd quit and find another job, but not in this economic climate and this would certainly be a case of where this guy thought that he was going to continue to get away with it because of that. I think he should have to support her for the rest of her legitimate working years in a manner that she has become accustomed to!!!!

    I thought that sort of sexual harrassment crap went out in the mid sixties!!! Brother. What sort of a workplace is that? The boss sounds like a looney tunes and I don't blame Ms. Anderson for suing. It's blatant sexual harrassment, I think. I wonder if that dingbat boss has found someone that would follow his 'rules'? Sounds like an ongoing thing , she should have come forward sooner , Not that she ever lead him on , But by not putting a stop to it sooner , sort of not big thing .     There may or may not be more to this story. We will never know for sure. It's just not that surprising that a woman would put up with this kind of behavior (we're practically taught to put up with it from birth) especially if she needed the job in this crappy economy we've got going.

    As far I know and assuming this author is correct. The woman has founds for filing a complaint or charges for sexual harassment. I haven't read anymore about this case. But it looks like she will win hands down. In my opinion!
