20 Percent of Teens Partake in 'Sexting': Should They Face Charges?

Whatever the latest technology is, teenagers will use it to get up to no good. But that doesn't make it any less alarming that nearly 20 percent of high school students partake in sexting, according to a new study.

Donald Strassberg, of the University of Utah, found that nearly 20 percent of high school students (18 percent of males, 17 percent of females) admitted to having sent a sexually explicit image on their cellphone. Almost twice as many said they had received a sexual image on their phone (50 percent of males, 31 percent of females), LiveScience reports.

And here's the really scary part: About 25 percent confessed that when they received a sexually explicit image, they forwarded it to others. Plus, more than 8 percent said they had sent a sexually explicit photo that they took of someone else to a third party.

But here's the thing, kids: You can get into big trouble for doing this. In many states, sending or receiving nude pictures of someone under 18 (including yourself) could put you at risk of facing child pornography charges. Do you think teens who sext should face charges?

    The age of consent in some states is 16 or 17 (my state it's 17). So they can legally have sex with people their age and even with adults (over 18). How does it make sense that they can legally have actual sex with adults even, yet can't "sext?" I mean, in my state a 17 year old could have sex with a 22 year old legally, but don't dare send a nude picture because THAT is "child" pornography? What the heck?

    Now for the teens younger than 16, they still shouldn't be charged. Leave the government out of it and let the parents deal with it.

    Sexting is such a stupid thing to do. Plenty of bad things can happen if you sext. Maybe the person on the other side of the phone asking you for sexts isn't the person you wanted to be. And, if there is a fight in the relationship or you break up, your ex might send the picture to lots of other people as an act of retaliation.

    Also, teens shouldn't be involved in sex.

    Yes its stupid and risky... but why should it be criminal? You are not hurting anyone else but yourself. The kids that are doing it are too young to face charges of child pornography. Viewing a picture of your own body isn't pornography.

    No, she's not a criminal. I guess we should define "sending naked photos" and "using the cell phone as a device to do harm through other's private data." Sexting in itself is not a crime. But it is the use of the form. I'm not a lawyer, but I know some things about law.

    Distributing pornographic material is a crime, no matter how one obtains the pictures. But the person sending it shouldn't be punished and do it at their own risk.
