Man sues McDonald's over nude photos!

A man is suing McDonald's after he left his mobile phone at one of the chain's restaurants and nude photos of his wife ended up online.

The suit was filed on Friday against the chain, the franchise owner, and the store manager, and seeks a jury trial and $US3 million in damages for suffering, embarrassment and the cost of having to move to a new home.

The suit says that Phillip Sherman left the phone in the Fayetteville, Arkansas store in July and that employees promised to secure it until he returned.

Manager Aaron Brummley declined to comment and other company officials didn't return messages.

    Who found it, a customer or an employee? If a customer found it and it cannot be proven that the customer didn't upload the pics, then the restaurant cannot be held responsible. Really, it is very unlikely that the restaurant can be held responsible because even if an employee found it, that does not rule out the possibility that another patron uploaded the pics, then left the phone in the booth, depending on what kind of phone it was.

    The moral of the story is don't have ANY pictures on your phone you don't want to become public domain.

    Quite the Romantic, walking around with pictures like that of his wife on the phone. Be more careful with personal property. Anyone could have found the phone.

    This has scam all over it. He shouldn't have had the pictures on his phone in the first place and who's to say that McDonalds is responsible. What if a customer picked up the phone before they were able to secure it? He shouldn't get a dime, I'm sick of all these sue happy people that don't want to take responsibility for thier actions and want to blame or sue somone else.

    McDonald's didn't spill the coffee on you, it didn't make you fat and it didn't make you forget your cellphone. Lack of personal responsibility strikes again. And don't leave pictures of your nekkid self on the phone if you don't want people to see them. Heck, go ahead and sue the guy who posted them, but McD's didn't do it.

    Naked pics. of your wife on your cell phone? That is just screaming trouble! And now he is suing for his own stupidity? And the sad part is he will probably get something out of it. Just like the mornon that burnt her mouth on McDonald's coffee, and sued because there wasn't a warning label on the cup that the contents inside are hot??? Somedays, I wish I were a complete moron and could get paid for it.

    I don't think he should be able to sue for monetary damages, but if somebody did something illegal by taking data from his phone maybe some jail time for a McDonald's employee. I'm so tired of all the frivolous lawsuits tying up our court system. Maybe if there was some kind of penalty tied to a lawsuit if it was found to be frivolous or without merit we'd stop some of this stuff.

    If McDonald's employees used his cell phone in an illegal manner while on work time - McDonald's is liable... fair or not. I don't blame the guy for being mad - but in reality - how many people would've known about the nude pics of his wife if he hadn't brought forth this suit? If the argument is for embarrassment - I think he is perpetuating it somewhat and would probably be reacting differently if he this had happened at a local ma and pa corner store. I see both sides.

    If he left it and someone got ahold of it then too bad. If he left it and they found it and said they would hold it till he could pick it up then too bad for them. As employees they should of known better than to steal from a customer and take advantage of them. Even though Mcdonalds itself had nothing to do with it they are held accountable for their employees and their actions.

    I barely trust the people that work at McDonalds to abstain from spitting in my food, why would anyone think that they would respect your privacy and not take advantage of you when you are stupid enough to leave something as valuable as nude pics of your wife in public place. Give me a break. I wouldn't expect my wallet to be full if I forgot it there either. Is it wrong, sure. Who's fault is it? The dumbass husband, his dumbass wife for letting him carry around intimate pictures everywhere he goes (did she expect him not to show them to anyone I wonder?), and the crooked little twerps that work at Micky D's. But I can't blame the McDonalds Corporation, that takes it a little too far. Greedy Perverted and stupid.

    If I were one of the employee's, I would file a lawsuit against him for indecent exposure. He could be a perv who left his phone there on purpose knowing that people would see it. Freakin perv!

    It is McDonalds responsibility for the safety of the phone and not to infringe on some one else’s property. It was neglect on the owner of the phone for leaving it there. But was promised it would be secure until he returned. No where in that conversation do I believe it meant to invade the privacy of the phone owner and humiliate his wife by willingly posting the photo's that they found in the phone that didn't belong to them. The same phone that was promised to be kept secure.
