Abercrombie & Fitch has a situation on its hands. The Situation, to be precise. Mike "The Situation" Sorrentino of "Jersey Shore" fame is reportedly suing the retailer for $4 million. He's targeting a line of t-shirts that sport phrases like "G.T.L. (You Know the Deal)" and "The Fitchuation," which are clearly inspired by his... erm... let's say "marketable" image.
The lawsuit reads, "[Abercrombie's] advertising campaign was immensely successful; as it resulted in hundreds of newspapers and thousands of internet bloggers publishing stories about [Abercrombie's] products and brand." Well, here's one more to add to the pile. Does "The Situation" have a case against Abercrombie & Fitch?

But anyways, first, GTL. Apparently this is a common meme amongst douchebags. Sorrentino didn't make it or own it, he just popularized it. He has no right to the image. No case here.
But, "The Fitchuation?" Back up a second. Forget that Jersey Shore characters are overwhelmingly douchbags who desperately need to just disappear. Forget that we naturally hate anything that might benefit them. And forget the underhanded view of copywrite law that finds technicalities to justify ripping off things. You see "The Fitchuation" on a shirt, you know EXACTLY what (And who) is being implied here. It is a Jersey Shore reference, and you don't need to have ever seen an episode of Jersey Shore to know that. It is a Jersey Shore t-shirt. Sorrentino has a case.
Wanna be upset at something? Be upset that consumers, and lets get real hear, most of the consumers who would buy this shirt think Jersey Shore is stupid, banal, and a blight on our culture but they also appreciate irony, support this kind of thing with there cash. Sorrentino has a right to his image. Be upset that people support that image, even if it is usually out of irony.
the main thing is, if you're gonna rip something off from someone, at least say thanks.
I believe the situation is as follows and the circumstance of the case is this.... "I truly thought your name was the Sue-tuation?"
