The Situation Sues Abercrombie & Fitch: Does He Have a Case?

Abercrombie & Fitch has a situation on its hands. The Situation, to be precise. Mike "The Situation" Sorrentino of "Jersey Shore" fame is reportedly suing the retailer for $4 million. He's targeting a line of t-shirts that sport phrases like "G.T.L. (You Know the Deal)" and "The Fitchuation," which are clearly inspired by his... erm... let's say "marketable" image.

The lawsuit reads, "[Abercrombie's] advertising campaign was immensely successful; as it resulted in hundreds of newspapers and thousands of internet bloggers publishing stories about [Abercrombie's] products and brand." Well, here's one more to add to the pile. Does "The Situation" have a case against Abercrombie & Fitch?

... dude... are you going to sue EVERYONE that uses the word "Situation"??

Mike... you do not own the word. You, dear idiot, are what people like to call a douche. First you try to sue your own father now this???

This just shows how much of a desperate jerk you are. Apparently the show isn't paying you enough.

    Get. A. Life.

I have no clue who this kid is or if he has a case or not but Abercrombie and Fitch are in deep doo doo according to the Wall Street Journal. It seems they have oversexualized their product, it is overpriced, and they are guilty of discriminatory hiring practices. Yesterday I read a news story about a young Muslim woman who is bringing a suit against them claiming they did not hire her because she wore a head covering to the interview.

Wait...didn't A+F ask Sorrentino to stop using there image because they didn't like being associated with him?

But anyways, first, GTL. Apparently this is a common meme amongst douchebags. Sorrentino didn't make it or own it, he just popularized it. He has no right to the image. No case here.

But, "The Fitchuation?" Back up a second. Forget that Jersey Shore characters are overwhelmingly douchbags who desperately need to just disappear. Forget that we naturally hate anything that might benefit them. And forget the underhanded view of copywrite law that finds technicalities to justify ripping off things. You see "The Fitchuation" on a shirt, you know EXACTLY what (And who) is being implied here. It is a Jersey Shore reference, and you don't need to have ever seen an episode of Jersey Shore to know that. It is a Jersey Shore t-shirt. Sorrentino has a case.

Wanna be upset at something? Be upset that consumers, and lets get real hear, most of the consumers who would buy this shirt think Jersey Shore is stupid, banal, and a blight on our culture but they also appreciate irony, support this kind of thing with there cash. Sorrentino has a right to his image. Be upset that people support that image, even if it is usually out of irony.

The Situation needs to get over himself. Hes a moron and he just wants more money. And his erm...nickname isnt even copyrighted-if it was it would be a totally different story. (at least....i dont think its copyrighted. I dont keep up with them)
  • TruXter 2011/11/20 17:34:57 (edited)
I think that even if he is a pud. they are using his likeness without breaking off an offer in gesture of kindness. so yeah.. he has a case.
  • disclaimer TruXter 2011/11/21 02:52:28
His likeness? Are they posting pictures of him? He doesn't have a trademark for the word situation, although I'm sure he'd like one.
  • TruXter disclaimer 2011/11/21 16:23:13
The context in which they are using it, is in reference to an image he created.
the main thing is, if you're gonna rip something off from someone, at least say thanks.
  • disclaimer TruXter 2011/11/21 18:02:39
I don't know, the whole situation is ridiculous. Oh no, I said situation--now he's going to sue me!

Next thing you know he'll be trying to trademark his pathetic nickname, and then I will be forced to hunt him down and snipe him.

Situation= (n.) Position, as regards the conditions and circumstances of the case.
I believe the situation is as follows and the circumstance of the case is this.... "I truly thought your name was the Sue-tuation?"
  • mtensmey 2011/11/20 03:39:29
From what I understand he has some of those phrases trademarked and if that's true he has a case. The law is that a public figure does have a right to collect from people who intently use their image, name whatever for profit. It doesn't say much for our society that this guy is a public figure, but that's not his fault.

If they are using a brand that he established they should pay him a royalty. It's a shame they didn't license it from him in the first place rather than force him to have to sue.
