Does Coakley Oppose Care for Rape Victims?
A campaign theme of Martha Coakley, including television ads which started running yesterday, attacks Scott Brown for supposedly sponsoring a bill to deny medical care to rape victims.

In fact, Brown merely proposed a religious exemption which would exempt those with a religious belief against providing "emergency contraception" (the so-called "morning after pill" which prevents pregnancy) from having to do so provided they had a plan in place for the victim to get the contraception elsewhere at no extra cost.

If Coakley thinks this amounts to denying care to rape victims, then she needs to explain why she supports the Senate health care bill which has an even broader religious and "moral" exemption for abortions, even in the case of rape.

Here is the language proposed by Brown (h/t Ruby Slippers) with regard to whether a health care provider or hospital must provide emergency contraception (emphasis mine):
Nothing in this section shall impose any requirements upon any employee, physician or nurse of any facility to the extent that administering the contraception conflicts with a sincerely held religious belief. In determining whether an employee, physician or nurse of any facility has a sincerely held religious belief administering the contraception, the conflict shall be known and disclosed to said facility and on record at said facility.

If it is deemed that said employee, physician or nurse of any facility has a sincerely held religious conflict administering the contraception, then said treating facility shall have in place a validated referral procedure policy for referring patients for administration of the emergency contraception that will administer the emergency contraception, which may include a contract with another facility. The referrals shall be made at no additional cost to the patient.

Brown ended up voting for the legislation even without this amendment.

Here is the language in section 1302(a)(3) of the bill (at page 125) passed by the Senate on December 24 (emphasis mine), which Coakley says she supports:
PROVIDER CONSCIENCE PROTECTIONS.—No individual health care provider or health care facility may be discriminated against because of a willingness or an unwillingness, if doing so is contrary to the religious or moral beliefs of the provider or facility, to provide, pay for, provide coverage of, or refer for abortions.
The Senate language will provide protection for hospitals and doctors who, due to religious or moral beliefs (a broader exemption than Brown's "religious beliefs" standard), refuse to provide abortions. This language is broad enough to provide an exemption even in the case of rape victims. This language also is not dependent upon whether the abortion service otherwise is allowed under the Hyde Amendment regarding federal funding of abortions.

Since Martha Coakley supports the Senate bill, does this mean Coakley wants to deny care to rape victims?

    As an Independent woman I am appauled at the smear tactics by the democrats. The flyer that Brown wants rape victims to be turned away is ludicrous, and I'm offended that she thinks woman aren't smart enough to see through it. She just swung my vote to Brown. The acts of a desperate campaign!

    She actually parroted the old Harry Reid sentiment that we cannot win against Terrorists, and went a mile further to say that there are no more terrorists in Afghanistan. Has she no eyes?     Health Care

    Energy and Environment

    I support common-sense environment policy that will help to reduce pollution and preserve our precious open spaces. I realize that without action now, future generations will be left to clean up the mess we leave. In order to reduce our dependence on foreign oil, I support reasonable and appropriate development of alternative energy sources such as wind, solar, nuclear, geothermal and improved hydroelectric facilities. I oppose a national cap and trade program because of the higher costs that families and businesses would incur.

    Education
    I am passionate about improving the quality of our public schools. Accountability and high standards are paramount. I support choice through charter schools, as well as the MCAS exam as a graduation requirement. I have worked to ensure that all children have access to a quality education. I am a strong advocate for the METCO program, which provides lower income students with broader educational opportunities.

    Immigration
    I recognize that our strength as a nation is built on the immigrant experience in America. I welcome legal immigration to this country. However, we are also a nation of laws and government should not adopt policies that encourage illegal immigration. Providing driver’s licenses and in-state tuition to illegal immigrant families will act as a magnet in drawing more people here in violation of the law and it will impose new costs on taxpayers. I oppose amnesty, and I believe we ought to strengthen our border enforcement and institute an employment verification system with penalties for companies that hire illegal immigrants.

    Veterans
    As a Lieutenant Colonel in the Army National Guard, I am uniquely aware of the importance and sacrifice of our men and women serving in the military. I have been a vigorous supporter of legislation providing benefits to returning service members, as well as, benefits for the families of those killed in action. I believe we need to recognize the sacrifice of all of our servicemembers by keeping better track of returning military personnel so they get the services they deserve. That includes providing them with first-class medical care and other benefits to which they are entitled. I am known as a leader on veterans' issues through my work on the Veterans and Federal Affairs Committee, the Hidden Wounds of War Commission, and the Governor's Task Force on Returning Veterans.

    Gun issues
    I support the Second Amendment and believe that citizens have the right to keep and bear arms as a basic constitutional liberty. I support safe and responsible gun ownership.

    Death penalty
    I believe there are some crimes that are so heinous that they deserve capital punishment. Our Government should have the ability to impose the death penalty in cases where it is justified.

    Abortion
    While this decision should ultimately be made by the woman in consultation with her doctor, I believe we need to reduce the number of abortions in America. I believe government has the responsibility to regulate in this area and I support parental consent and notification requirements and I oppose partial birth abortion. I also believe there are people of good will on both sides of the issue and we ought to work together to support and promote adoption as an alternative to abortion.

    Marriage
    I believe marriage is between a man and a woman. States should be free to make their own laws in this area, so long as they reflect the people's will as expressed through them directly, or as expressed through their elected representatives.

    Israel
    Israel has made enormous sacrifices in an attempt to secure peace – including unilateral withdrawal from Gaza. I support a two-state solution that reaffirms Israel’s right to exist and provides the Palestinians with a place of their own where both sides can live in peace and security. As our closest ally in the Middle East, Israel lives every day under the threat of terror yet shares with America a dedication to democratic ideals, a respect for faith, and a commitment to peace in the region. Until a lasting peace is achieved, I support the security barrier erected by Israel which has proven successful in protecting Israeli civilians from terrorist attacks.

    Iran
    I support the bi-partisan Iran sanctions bill and believe that until Ahmadinejad gives up his nuclear ambitions he should be isolated from the rest of the world. With its reckless pursuit of nuclear weapons, Iran represents the biggest threat to Israel. Ahmadinejad is a Holocaust denier who has threatened to wipe Israel off the map. Meeting with him confers legitimacy when the only correct response is to treat him as an outcast. A personal meeting with Ahmadinejad, as suggested by my opponent, would embolden him and be used as a propaganda tool to strengthen his position."

    I watched the debate last night and was very disappointed that once again the media are choosing our candidates. The Independent candidate Joe Kennedy was the only one who said anything remotely meaningful and he was ignored. They allowed Brown and Coakly to get into a back in forth arguement and completely ignored the other candidate. I understand we need to take the seat from the Democrats but I am tired of being played for a fool by the two major party's and the media. Look at this clip and tell me who makes the most sense.

    I agree with what you are saying but it is up to the "PEOPLE" of any given state to break out of the mold & MASS is not a state that is likely to do that anytime soon.... Although I do agree in a "Perfect" world all people would be break from the norm but as you can see we don't live in a perfect world as of yet. And that sometimes means you are cheering for the lesser of 2 evils ...

    If we can break Mass from voting blindly for the Dem ... In time we may also be able to get them to think & vote out of the box for an independant ... I have been working Browns phones because in this instance he is ~in my view the lesser of 2 highly likely evils ~ it is a battle just to get them to consider voting away from the Democratic Kennedy legacy !

    Once again ... NEITHER side is addressing the hidden TRUTH of the controversy. The Congress has NO Constitutional business involving itself in the question of abortions. The matters of legality and morality surrounding it are ENTIRELY in the local sovereign realm of those People inhabiting their particular States.

    We live in a Federal Union ... NOT a monolithic Nation. We EXPECT the Marxie to defend Congressional intrusiveneness, but 'Republican' Senatorial candidates pandering to Constitutionalists with OTHERWISE Conservative rhetoric ('the People's Seat'), while yet pursuing the same untrammeled un-Constitutional empowerment as the Marxies, leaves me in a state of concern.

    I do believe the people are catching on and the SEIU is wasting our money. No trash just a fact Mom. Great question. And I could not actually answer the denied care for the rape victim question because I am not sure what is still hidden in the bill or what they may add in conference. Anything so far from us has not mattered and they do as they want. We have no say in the bill, but we do have a say if it passes. Thanks Mom
