Rumors and speculation about diamond rings, secret engagements and wedding plans for Kim Kardashian and Kanye West have been circulating for months. And while the power couple seems happy together, there is just one big problem coming between them: Kim is still married to basketball player Kris Humphries.

It’s been over a year since Kardashian filed for divorce from the Brooklyn Net’s forward but the proceedings are dragging on because Humphries' lawyers are not ready to go to trial. He wants to file for an annulment so no trace of the whole 72-day debacle exists on his marital record. He claims the marriage was based on fraud and the whole thing was just a way to boost ratings for “Keeping up with the Kardashians.”

Kim just wants a traditional divorce so she can move on with her life (that’s code for marry Kanye and have babies.) Her lawyer, Laura Wasser, says Kim is currently “handcuffed” to her ex and that Humphries' attorneys are going on a “fishing expedition” trying to make a case.

An L.A. Superior Court judge scheduled a hearing for February 15 to determine the date for the trial to begin. So it looks like Kim can start dreaming of a June wedding. What do you think? Should Kim’s current marriage to Kris Humphries end in annulment or divorce?

Annulment isn't on the table Because they consummated the marriage. Also, as they didn't have a catholic wedding, why would they be eligible for an annulment? I could be wrong (I frequently am) but I thought annulment was something invented by the catholic church for Catholics...????

What a sad world we live in, who cares, obviously we all have opinions on this, but this superficial person should no way be considered a celebrity, has she been in any movies ( oops almost forget she became famous when her momager sold the sex tape..suposodely) please make it go away, if she is holding out because she doesn't want to give back the ring, I am Mr. West will give her an even more expensive one, at a price that could probably feed lots of starving people in the world. I am hoping for a day when none of the Kardashians do not make a headline. Is that possible?

If indeed it was a fraudulent marriage arrangement, then an annulment is proper. She can still marry as she pleases whether it is after a divorce or an annulment. The important thing is truth and fairness, not just simple convenience.

I haven't seen anything where she says she feels so 'handcuffed' that she'll agree to the annulment. Accordingly, at the very least, I think Humphries is entitled to his day in court to prove he was as much an innocent bystander as he claims.

I think neither, but that isn't an option. What don't people understand about 'til death do us part? That being said why does she care how the marriage gets ended as long as it's over. From what I see he has a legitimate axe to grind. Why not agree to an annulment as long as you can get out of the marriage?

If he got into the marriage knowing it was based on fraud then deal with the end result. You don't deserve an annulment and a "trace"-free get away when you entered into this under the wrong circumstances.

If it was truly a publicity stunt, which appears to be most likely, then the marriage was based on a lie. Grounds for annulment.
