Is Madonna's Song Title Change Enough?

You'd think after nearly 30 years of this, Madonna might know how to avoid a trademark lawsuit. At the very least, you'd think her Interscope / Live Nation partners would be able to shoot her a memo. No such luck. She still managed to name her latest single "Girls Gone Wild" without the permission of the popular porn franchise, and creator Joe Francis is not letting her off easy. He's already gotten her to change the title to "Girl Gone Wild," and he's not done yet.

Frances told The New York Daily News, "We won a battle but we didn't win the war. I actually really like the song, which doesn’t mean anything. It's business. We've been very fair with licenses. And we've been talking (with Madonna's people), and I think we're going to get somewhere that will be mutually satisfactory ... This is not personal at all. I’m flattered, quite frankly, that a brand I’ve developed and created has achieved this level of notoriety."     No need for a change--since the phrase was already in use BEFORE JF trademarked it. You shouldn't be permitted to trademark a phrase already in use.

    More than enough, actually. You cannot trademark a phrase. You just can't. Joe is an idiot. If you like the song why continue to sue? Just let it go. He is obviously just trying to get media attention.

    Why should she change it anyways? SHE IS AN ARTIST!!! She has always pushed buttons with ALL of her work. Why should this be any different?

    Seriously, I think trademarking, patenting, and copyrighting phrases and a few other things is just foolsplay, but since people think this is so important to the human race, then people should follow the rules.

    Ludacris already has a song called "Girls Gone Wild" from 2006.
    We could release a single titled "Just Do It" tomorrow and Nike couldn't do squat to stop it.

    Why should it matter? It's ridiculous, it's a song!! It is not like someone is naming another video product or other tangible the same. It's not infringing on another's property!! It's just plain stupid!!! They both have more money than they know what to do with.

    Its just so silly that he claims that he coined the phrase when it's been around for years and years on end. He just put a trademark to it in the form of smut. All he wants is more money coz he's flat broke so he's milking Madonna for all she's worth, if he has his way. He's just being an arsehole about it.
