Actually I sort of find myself in a similar situation, not too sure what to do but obviously it's not on the same scale!

He loves her more than half his fortune if that is not true enough then nothing is.

A pre-nup only comes into play in a divorce - not death. If she divorces him - as I understand it - she is only entitled to go after his earnings from the time they married and going forward. She cannot go after his assets that were earned pre-marriage.

When he dies - I'm sure Hef has a trust in place that defines who gets what. I'm sure he has cut his hot care giver in for a nice sum that will set her up quite nicely for life - which is her end of this bargain. But I'm sure Hef has also identified others in his life - kids, charities, etc. - who will also share in his spoils.

Now....if there is a "last minute" revised trust giving all to her......then that would be an Anna Nicole Smith situation.

I'm sure if he isn't signing a pre-nup its because he thinks she is the one who will be with him til he dies. She's gorgeous, if I were as old as him and could have her suck on it for a few years I think I'd say to hell with the pre-nup too! Plus if she is that young and the type to pose for Playboy I'm sure she is really flattered that the all time biggest playboy chose her to marry out of all the other available hot girls he could have.

Too many people have the idea that a prenup is somehow unromantic. Granted, there are people who brow-beat their future partners into signing - or else no wedding, or spring it the night before or the morning of the wedding so the (usually) bride won't be able to have her attorney check it out, without having to postpone the wedding. But for most people it is just realistic planning. And for those who say, "why plan for divorce", well, just look at the statistics. And for those who say, "my soon-to-be would never be mean or try to rip me off", well, you have never been through a nasty divorce where someone you thought was kind and caring turned into a raving, vengeful, lunatic. I haven't been through this, but I know people who have. I'm not talking about multi-millionaires here. Just regular people who have something to lose making sure their children will get their money/belongings/mother's china instead of some vindictive ex, and worse, when they die, the woman that they left the original wife for, who keeps everything out of spite. Seen it happen more than once.

Actually, I wanted to put "neither." Can you imagine a judge that would award too much of a man't fortune to some gold-digger that he's divorcing?
