Boycott Ed Hardy!

I have a long time friend that got a design internship with Ed Hardy Clothing Co. with promises that if he was a great artist, he was promised a full time position in the company. The internship was unpaid and worked designing Ed Hardy T-shirts, baby clothes, keychains, etc. My friend worked really hard for 3 months, unpaid, and all he got in return was Ed Hardy shot glasses and hats. Although he interned with Ed Hardy for free working 20 hours a week, he can testify that he was treated like trash and was often told his designs sucked and that his pieces of art will never make it to the stores! --- Until the day came that he found out one of his T-Shirt designs were being sold for $179.99 a piece at the Northridge mall. He immediately contacted Ed Hardy claiming that he deserves some kind of pay or at least, what he was promised, a full time position. Which one did he get? Any! My friend was immediately fired as an intern and was scammed. It is pretty shitty that a company like Ed Hardy hires unpaid interns, sells their designs for more than 100 bucks, and gives their interns nothing whatsoever in return.

People if you worked for Ed Hardy or any other company under the pretense of internship that was actually an unpaid job please pursue you legal rights and sue them. Internships have specific requirements please look them up. Just calling something an internship does not allow any company to have people work for them for free. Know your rights and sue the bastards. Boycott Ed Hardy!

    Actually, in the state of California it is unpaid internships are illegal.....ESPECIALLY if you work on a project that gains profit for the company...

    And you should boycott Ed Hardy....did you see what he did outside MJ's house after he died? Shameful!

    I heard some similar stories too, one of my friends been used like that but not as a designer , some other position.
    As a designer I will add that their staff is extremely tasteless and I cannot imagine how people can pay so much money to get their staff. Even the worse designer or illustrator couldn't possible design and make those. Look at the color combinations. Only non professionals could put staff like that together. I see this company dont care about anything besides making money, so I guess the best punishment for them is to make people stop buying their products. I will call their designs anti - design which are randomly put together. And I cannot understand those who will intern for them, how can you put their name in your resume? It's a shame. That means you are so vulgar and untastefull that you spend your time on those designs. Their staff is for low - low class people who think that if they pay more for clothing they will become better. Those are so esthetically unpleasing to my eyes that I better see some overweight person naked in front of me than someone who have their products on. I could go over and over but I want to finish my saying. And PLEASE dont buy untastefull products, respect your body and be aware of what's good and what's not. Thank you for attention.

    Tell your friend to copyright the design as soon as he can. Have him hire a lawyer soon afterwards so that he can sue Ed Hardy for copyright infringement unless Ed Hardy is willing to settle out of court with a legal document that states your friend get a percentage of the profits. One thing about being in a corporation, anything thing you make for a company is theirs property. So, unless Ed Hardy copyrighted that design, your friend might have a fighting chance to bring down a corporation, or at least embarrass them.

    Here's the facts: (Besides the labor issue) ED Hardy couldn't make it as an artist in San francisco in the wild and wooly hippie/Zap Comix/underground newspaper days of the late 1960s when he went there from southern cali...and man, almost anybody could get published so he slunk over to the sleeze area to do tatoos. Only in the last 20 years have tat artists become real good. Except for the grand master--Lyle tuttle. But now, Audigier is diggin his own grave , not only with labor issues, but , geez, look at the art now, it aint even raw tat style...its "suburban mallisized" and way too crowded, line art that has been over photoshopped...the guy is LOST, design wise.

    I think his shit sucks....never really understood why he was sooo popular...not to mention the cost to print the shirt is about a buck or two and he is not only stealing someones work but he charges almost $200 to wear the stolen property!

    No pay/low pay internships are illegal in California.

    The U.S. DoL utilizes the below listed criteria, as created by the U.S.S.C.
    (Walling v. Portland Terminal Co. (1947) 330 U.S. 148), to determine whether
    a person is really an intern, or whether they are an employee who must be
    paid and treated according to the Fair Labor Standards Act (FLSA):

    1. The training is similar to that which would be given in a vocational school;
    2. The training is for the benefit of the trainee;
    3. The trainees do not displace regular employees, and work under close observation;
    4. The employer that provides the training derives no immediate advantage from the activities of the trainees and on occasion the employer’s operations may
    actually be impeded.

    Long story short interns are not a source of free/low pay labor so proceed carefully as the wage and hour folk have no sense of humor and often link the information to the IRS which includes an element of personal liability.


    there may be issues of copyright abuse but you'll need a lawyer that knows IPR law (garden verity lawyers are not qualified)

    yea its illegal anywhere in the us not to pay someone who is working for you. calling work an internship does not excuse you from the law. apparently ed hardy has been lucky up til now. please sue ...them get a class action suit going whatever. california has some particularly interesting laws including anyone within the company can report and sue them for avoiding paying an employee, not just the person who was stiffed. for gods sake make an example of these some of the most blatant offenders.

    A Rep for Ed Hardy came up to the House of a Very Famous Pin-Up Artist I used to work for in Malibu, I know alot of people don't know who this "Guy" is, but the Rep, CEO or whom-ever drove up in a Lamborghini Murcielago, it wasnt a Rental either. We are talking BIG BUCKS here, forget about Boycotting because you have some fukhedz here that will "still buy ANY shirts even Ed's because theyre cool" or they just dont care or live out in the Backbone of America, the REAL people that do an honest living and keep the country thriving. They could care less for what the folks here in Ca. or New York or what-ever big city types wear.
    Gather petitions, but mostly, Get a Lawyer, bite them in the Ass where it hurts-theyre pockets, SUE them.
    The Pin-Up artists Husband asked my co-worker "what do you think?"     Lets take it to the extreme, EVERYTHING around you had to be drawn! So if you get paid for your 9 to 5, shouldnt an Artist with a Professional Skill get paid? You bought it, so that means a Product works for you, the creator then- needs to be compinsated.
    Here in Lost Angeles/California, Ed's stuff is huge, and all I see is posuers, middle aged Men who want to look "young" and Female fashionistas wear their stuff, but they are "buying/paying" those rediculous prices for them.
    PLEASE tell your friend, to not only SUE them, but create a Blog because it may have happened to other Artists as well.
    Remember Ed himself may have not Ripped your friend off personally, but his Reps represent HIM, its HIS name. SUE the Fux!!!

    btw, ask your friend if he signed any papers saying his designs were property of the company once created. If not, sue!

    This also happened to me, but I was working 40 hours/week for a local company unpaid! Screw internships.

    I'm so happy I stumbled this site! I HATE ED HARDY or whoever the real designer's name is... his art seriously looks like a blind three-year old put a crayon in his mouth and scribbled on construction paper.
